    Amends the Counties Code. Extends the applicability provision of the Division to all counties within the State (currently, only DuPage County). Adds a Section concerning the rights of employees of a former unit of local government after it has been dissolved into the governmental unit assuming the functions of the former unit of local government. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
55-44010 and by adding Section 5-44060 as follows:
 
6    (55 ILCS 5/5-44010)
7    Sec. 5-44010. Applicability. The powers and authorities
8provided by this Division 5-44 apply to all counties within the
9State only to counties with a population of more than 900,000
10and less than 3,000,000 that are contiguous to a county with a
11population of more than 3,000,000 and units of local government
12within such counties.

14    (55 ILCS 5/5-44060 new)
15    Sec. 5-44060. Rights of former employees. On the effective
16date of dissolution, the employees of the former unit of local
17government shall be transferred to the governmental unit
18assuming the functions of the former unit of local government.
19The governmental unit assuming the functions of the former unit
20of local government shall exercise the rights and
21responsibilities of the former unit of local government with
22respect to those employees. The status and rights of the

1employees of the former unit of local government under any
2applicable contracts or collective bargaining agreements,
3historical representation rights under the Illinois Public
4Labor Relations Act, or under any pension, retirement, or
5annuity plan shall not be affected by this amendatory Act.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
