1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Green Buildings Act is amended by changing
5Section 15 as follows:
 
6    (20 ILCS 3130/15)
7    Sec. 15. Green Buildings Standards.
8    (a) All new State-funded building construction and major
9renovations of existing State-owned facilities are required to
10seek LEED, Green Globes, or equivalent certification.
11    (b) All construction and major renovation projects,
12regardless of size, must achieve the the highest level of
13certification practical within the project budget.
14        (1) New buildings and major renovations of less than
15    10,000 square feet must meet the highest standard of the
16    Leadership in Energy and Environmental Design's rating
17    system for new commercial construction and major
18    renovation projects, as established by the United States
19    Green Building Council, or an equivalent standard,
20    including, but not limited to, the Green Building
21    Initiative's Green Globes USA design program. USGBC LEED,
22    GBI Green Globes, or the equivalent certification is not
23    required.

1        (2) New buildings and major renovations of 10,000
2    square feet or more must achieve the silver building rating
3    of the Leadership in Energy and Environmental Design's
4    rating system for new commercial construction and major
5    renovation projects, as established by the United States
6    Green Building Council, or an equivalent standard,
7    including, but not limited to, a two-globe rating in the
8    Green Globes USA design program. USGBC LEED, GBI Green
9    Globes, or the equivalent certification is required.
10    (c) Exemptions to these standards are buildings that are
11not "comfort" conditioned as determined by the Board. However,
12the project design team must document and incorporate all
13appropriate sustainable building methods, strategies, and
14technologies in the final design.
15    (d) State agencies and the project design team may apply to
16the Board for a waiver from these standards.
17    (e) Waivers shall be granted by the Board or an appropriate
18agency when the applicant can demonstrate and document:
19        (1) An unreasonable financial burden, taking into
20    account the operating and construction costs over the life
21    of the building and the total cost of ownership of the
22    building.
23        (2) An unreasonable impediment to construction.
24        (3) The standards would impair the principal function
25    of the building.
26        (4) The standards would compromise the historic nature

1    of the structure.
2    Documentation on the submittal must include at a minimum:
3        (1) Life cycle cost analysis.
4        (2) Energy modeling.
5    The design team must provide the documentation for the new
6project to confirm that LEED, Green Globes, or the equivalent
7construction standards have been followed.
8    (f) In addition to any required LEED, Green Globes, or the
9equivalent criteria, the Board shall require that all projects
10referenced in subsection (a) implement at least one LEED
11alternative transportation criterion for public transportation
12or bicycle access.
13    (g) The green building standards contained in this Act
14shall be analyzed and evaluated by the Board 5 years after the
15effective date of this Act or upon the completion of 10 Board
16green projects, whichever comes first.
