    Amends the Illinois Vehicle Code. Provides that motorized wheel chairs and electric personal assistive mobility devices are required to display a slow-moving vehicle emblem while being operated on any public way designed for the use of vehicles, including any berm, median, shoulder, designated bicycle lane, or crosswalk.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 12-709 as follows:
 
6    (625 ILCS 5/12-709)  (from Ch. 95 1/2, par. 12-709)
7    Sec. 12-709. Slow-moving vehicle emblem.
8    (a) Every animal drawn vehicle, moped, farm tractor,
9implement of husbandry and special mobile equipment, when
10operated on a highway must display a slow-moving vehicle emblem
11mounted on the rear except as provided in paragraph (b) of this
12Section. Special mobile equipment is exempt when operated
13within the limits of a construction or maintenance project
14where traffic control devices are used in compliance with the
15applicable provisions of the manual and specifications adopted
16under Section 11-301 of the "Illinois Vehicle Code".
17    (a-5) Every motorized wheel chair and electric personal
18assistive mobility device when operated on any public way
19designed for the use of vehicles, including any berm, median,
20shoulder, designated bicycle lane, or crosswalk, must display a
21slow-moving vehicle emblem mounted on the rear except as
22provided in paragraph (b) of this Section.
23    (b) Every vehicle or unit described in paragraph (a) or

1(a-5) of this Section when operated in combination on a highway
2must display a slow-moving vehicle emblem as follows:
3        1. Where the towed unit or any load thereon partially
4    or totally obscures the slow-moving vehicle emblem on the
5    towing unit, the towed unit shall be equipped with a
6    slow-moving vehicle emblem. In such cases the towing unit
7    need not display the emblem.
8        2. Where the slow-moving vehicle emblem on the towing
9    unit is not obscured by the towed unit or its load, then
10    either or both may be equipped with the required emblem but
11    it shall be sufficient if either displays it.
12        3. A registered truck towed behind a farm tractor in
13    conformity with the provisions of Section 11-1418 of the
14    "Illinois Vehicle Code" must display a slow-moving vehicle
15    emblem in the manner provided in paragraph (c) while being
16    towed on a highway if the emblem on the towing vehicle is
17    partially or totally obscured.
18    (c) The slow-moving vehicle emblem required by paragraphs
19(a), (a-5), and (b) of this Section must meet or exceed the
20specifications and mounting requirements established by the
21Department. Such specifications and mounting requirements
22shall, on and before August 31, 2004, be based on the
23specifications adopted by the American Society of Agricultural
24Engineers and published by that body as ASAE S 276.2 dated
25March, 1968 or as ASAE S 276.5. On and after September 1, 2004,
26the specifications and mounting requirements shall be based on

1the specifications adopted by the American Society of
2Agricultural Engineers and published by that body as ASAE S
3276.5 NOV 97. No advertising or other marking shall appear upon
4the emblem except that specified by the American Society of
5Agricultural Engineers to identify the standard to which the
6material complies. Each original package containing a
7slow-moving vehicle emblem shall display a notice on the
8outside of the package stating that such emblem shall only be
9used for the purposes stated in subsections (a), (a-5), and
10(b).
11    (d) A slow-moving vehicle emblem is intended as a safety
12identification device and shall not be displayed on any vehicle
13nor displayed in any manner other than as described in
14paragraphs (a), (a-5), (b), and (c) of this Section. A
15slow-moving vehicle emblem may not be displayed in public view
16from a highway on an object other than a vehicle or unit
17described in subsection (a) or (a-5) of this Section or a
18vehicle required to display a slow-moving vehicle emblem under
19subsection (e) of Section 11-1426.1 of this Code. A violation
20of this subsection (d) is a petty offense punishable by a fine
21of $75.
