SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.201

    Amends the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services may purchase services and materials associated with the costs of developing, implementing, and maintaining (rather than developing and implementing) a data warehouse comprised of management and decision making information in regard to the liability associated with, and utilization of, medical and related services, out of moneys available for that purpose. Removes a provision requiring the Department to perform all necessary administrative functions to expand its linearly-scalable data warehouse to encompass other healthcare data sources at both the Department of Human Services and the Department of Public Health, and to supply quarterly reports to the Commission on Government Forecasting and Accountability detailing progress toward this mandate. Removes language that (i) required the departments of Healthcare and Family Services, Public Health, and Human Services and the Division of Specialized Care for Children to jointly prepare a work plan for fully integrating specified data sets into the medical data warehouse by September 1, 2009 and (ii) required the Department of Healthcare and Family Services to submit status reports on the progress of these and other specified efforts to the Governor and the General Assembly no later than October 1, 2009 and April 1, 2010, with a final report due no later than November 1, 2010. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 12-4.201 as follows:
 
6    (305 ILCS 5/12-4.201)
7    Sec. 12-4.201.Data warehouse concerning medical and
8related services.
9    (a) The Department of Healthcare and Family Services may
10purchase services and materials associated with the costs of
11developing, and implementing, and maintaining a data warehouse
12comprised of management and decision making information in
13regard to the liability associated with, and utilization of,
14medical and related services, out of moneys available for that
15purpose.
16    (b) (Blank). The Department of Healthcare and Family
17Services shall perform all necessary administrative functions
18to expand its linearly-scalable data warehouse to encompass
19other healthcare data sources at both the Department of Human
20Services and the Department of Public Health. The Department of
21Healthcare and Family Services shall leverage the inherent
22capabilities of the data warehouse to accomplish this expansion
23with marginal additional technical administration. The purpose

1of this expansion is to allow for programmatic review and
2analysis including the interrelatedness among the various
3healthcare programs in order to ascertain effectiveness
4toward, and ultimate impact on, clients. Beginning July 1,
52005, the Department of Healthcare and Family Services
6(formerly Department of Public Aid) shall supply quarterly
7reports to the Commission on Government Forecasting and
8Accountability detailing progress toward this mandate.
9    (c) The Department of Healthcare and Family Services (HFS),
10the Illinois Department of Public Health, the Illinois
11Department of Human Services, and the Division of Specialized
12Care for Children, University of Illinois at Chicago, with
13necessary support from the Department of Central Management
14Services, shall integrate into the medical data warehouse
15individual record level data owned by one of these agencies
16that pertains to maternal and child health, including the
17following data sets:
18        (1) Vital Records as they relate to births, birth
19    outcomes, and deaths.
20        (2) Adverse Pregnancy Outcomes Reporting System
21    (APORS).
22        (3) Genetics/Newborn Screenings/SIDS.
23        (4) Cornerstone (WIC, FCM, Teen Parents,
24    Immunization).
25        (5) HFS medical claims data.
26        (6) I-CARE.

1        (7) Children with Special Healthcare Needs Data.
2    By September 1, 2009, the departments of Healthcare and
3Family Services, Public Health, and Human Services and the
4Division of Specialized Care for Children shall jointly prepare
5a work plan for fully integrating these data sets into the
6medical data warehouse. The work plan shall provide an overall
7project design, including defining a mutually acceptable
8transfer format for each discrete data set, the data update
9frequency, and a single method of data transfer for each data
10set. By October 1, 2009, the Department of Public Health shall
11grant to the Department of Healthcare and Family Services
12complete access to all vital records data. The Department of
13Public Health shall prepare a report detailing that this task
14has been accomplished and submit this report to the Commission
15on Government Forecasting and Accountability by October 15,
162009. By March 1, 2010, the data sets shall be completely
17loaded into the medical data warehouse. By July 1, 2010, data
18from the various sources shall be processed so as to be
19compatible with other data in the medical data warehouse and
20available for analysis in an integrated manner.
21    With the cooperation of the other agencies, HFS shall
22submit status reports on the progress of these efforts to the
23Governor and the General Assembly no later than October 1, 2009
24and April 1, 2010, with a final report due no later than
25November 1, 2010.
26    (c-5) On an ongoing basis, the 4 agencies shall review the

1feasibility of adding data from additional sources to the
2warehouse. Such review may take into account the cost
3effectiveness of adding the data, the utility of adding data
4that is not available as identifiable individual record level
5data, the requirements related to adding data owned by another
6entity or not available in electronic form, whether sharing of
7the data is otherwise prohibited by law and the resources
8required and available for effecting the addition.
9    (d) The departments shall use analysis of the data in the
10medical data warehouse to improve maternal and child health
11outcomes, and in particular improve birth outcomes, and to
12reduce racial health disparities in this area.
13    (e) All access and use of the data shall be in compliance
14with all applicable federal and State laws, regulations, and
15mandates.
16    (f) Notwithstanding anything in this Section, data
17incorporated into the data warehouse shall remain subject to
18the same provisions of law regarding confidentiality and use
19restrictions as they are subject to in the control of the
20contributing agency. The Department of Healthcare and Family
21Services shall develop measures to ensure that the interplay of
22the several data sets contributed to the data warehouse does
23not lead to the use or release of data from the data warehouse
24that would not otherwise be subject to use or release under
25State or federal law.

2    Section 99. Effective date. This Act takes effect upon
