AMENDMENT TO HOUSE BILL 1729

2    AMENDMENT NO. ______. Amend House Bill 1729 by replacing
3everything after the enacting clause with the following:

4    "Section 5. The Emergency Medical Services (EMS) Systems
5Act is amended by changing Section 2 as follows:

6    (210 ILCS 50/2)  (from Ch. 111 1/2, par. 5502)
7    Sec. 2. Legislative intent; construction of Act. The
8Legislature finds and declares that emergency medical services
9are essential services in the State of Illinois and it is the
10intent of this legislation to provide the State with systems
11for emergency medical services by establishing within the State
12Department of Public Health a central authority responsible for
13the coordination and integration of all activities within the
14State concerning pre-hospital and inter-hospital emergency
15medical services, as well as non-emergency medical transports,
16and the overall planning, evaluation, and regulation of

1pre-hospital emergency medical services systems.
2    The provisions of this Act shall not be construed to deny
3emergency medical services to persons outside the boundaries of
4this State nor to limit, restrict, or prevent any cooperative
5agreement for the provision of emergency medical services
6between this State, or any of its political subdivisions, and
7any other State or its political subdivisions or a federal
8agency.
9    The provisions of this Act shall not be construed to
10regulate the emergency transportation of persons by friends or
11family members, in personal vehicles that are not ambulances,
12specialized emergency medical service vehicles, first response
13vehicles or medical carriers.
14    This legislation is intended to provide minimum standards
15for the statewide delivery of EMS services. It is recognized,
16however, that diversities exist between different areas of the
17State, based on geography, location of health care facilities,
18availability of personnel, and financial resources. The
19Legislature therefore intends that the implementation and
20enforcement of this Act by the Illinois Department of Public
21Health accommodate those varying needs and interests to the
22greatest extent possible without jeopardizing appropriate
23standards of medical care, through the Department's exercise of
24the waiver provision of this Act and its adoption of rules
25pursuant to this Act.
