SYNOPSIS AS INTRODUCED:
 
15 ILCS 50/17 new
20 ILCS 5/5-20  was 20 ILCS 5/4

    Amends the Gubernatorial Boards and Commissions Act. Provides that a person is ineligible for appointment or reappointment to any board or commission for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official. Amends the Civil Administrative Code of Illinois. Provides that a person is ineligible for appointment or reappointment as the head officer of a department of State government for a term of office beginning on or after the effective date of the amendatory Act, if the person is a spouse, child, or spouse of a child of a State official. Defines "official".

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gubernatorial Boards and Commissions Act is
5amended by adding Section 17 as follows:
 
6    (15 ILCS 50/17 new)
7    Sec. 17. Eligibility for appointment or reappointment to a
8board or commission. A person is ineligible for appointment or
9reappointment to any board or commission for a term of office
10beginning on or after the effective date of this amendatory Act
11of the 97th General Assembly, if the person is a spouse, child,
12or spouse of a child of a State official, as that term is
13defined in subsection (c) of Section 2 of the Lobbyist
14Registration Act.
 
15    Section 10. The Civil Administrative Code of Illinois is
16amended by changing Section 5-20 as follows:
 
17    (20 ILCS 5/5-20)  (was 20 ILCS 5/4)
18    Sec. 5-20. Heads of departments.
19    (a) Each department shall have an officer as its head who
20shall be known as director or secretary and who shall, subject
21to the provisions of the Civil Administrative Code of Illinois,

1execute the powers and discharge the duties vested by law in
2his or her respective department.
3    The following officers are hereby created:
4    Director of Aging, for the Department on Aging.
5    Director of Agriculture, for the Department of
6Agriculture.
7    Director of Central Management Services, for the
8Department of Central Management Services.
9    Director of Children and Family Services, for the
10Department of Children and Family Services.
11    Director of Commerce and Economic Opportunity, for the
12Department of Commerce and Economic Opportunity.
13    Director of Corrections, for the Department of
14Corrections.
15    Director of the Illinois Emergency Management Agency, for
16the Illinois Emergency Management Agency.
17    Director of Employment Security, for the Department of
18Employment Security.
19    Secretary of Financial and Professional Regulation, for
20the Department of Financial and Professional Regulation.
21    Director of Healthcare and Family Services, for the
22Department of Healthcare and Family Services.
23    Director of Human Rights, for the Department of Human
24Rights.
25    Secretary of Human Services, for the Department of Human
26Services.

15    (b) A person is ineligible for appointment or reappointment
16as the head officer of a department for a term of office
17beginning on or after the effective date of this amendatory Act
18of the 97th General Assembly, if the person is a spouse, child,
19or spouse of a child of a State official, as that term is
20defined in subsection (c) of Section 2 of the Lobbyist
21Registration Act.
