1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
55-21 as follows:
 
6    (105 ILCS 5/5-21)  (from Ch. 122, par. 5-21)
7    Sec. 5-21. Gifts, grants, donations, legacies - Title to
8property. The The trustees of schools in townships in which
9that office has not been abolished as provided in subsection
10(c) of Section 5-1 may receive any gift, grant, donation or
11legacy made for the use of any school or library or for any
12other school purpose within their jurisdiction. They are
13invested in their corporate capacity with the title of all
14school buildings and school sites, except as otherwise provided
15by clause (3) of subsection (b) of Section 5-1 with respect to
16school districts which have withdrawn from the jurisdiction and
17authority of the trustees of school. All conveyances of real
18estate made to the trustees of schools shall be made to them in
19their corporate name and to their successors in office. School
20districts may take and convey title to real estate to be
21improved by buildings or other structures for vocational or
22other educational training of pupils as provided in Section
2310-23.3. If legal title to the real estate to be so improved

1for vocational or other educational training of pupils as
2provided in Section 10-23.3 is not held by the school board of
3the school district, the trustees of schools or other school
4officials having legal title to those school sites or other
5school property shall convey to the school district the title
6to any such school site or other school property or portion
7thereof held for such district, to be used as provided in
8Section 10-23.3, upon being presented with a resolution adopted
9by at least 2/3 of the members of such board requesting such
10conveyance.
11    If the trustees of schools for a township are no longer in
12existence, the school district shall take and convey title to
13all school buildings and school sites to be acquired within
14such township. If the trustees of schools had previously taken
15title to a school building or a school site and such trustees
16are no longer in existence, the school district shall by
17operation of law automatically be vested with title to all
18school buildings and school sites within such township and
19shall have authority to convey title thereto.
