AMENDMENT TO SENATE BILL 3213

2    AMENDMENT NO. ______. Amend Senate Bill 3213, AS AMENDED,
3as follows:
 
4immediately below Section 5, by inserting the following:
 
5    "Section 10. The Hemophilia Care Act is amended by changing
6Section 3 as follows:
 
7    (410 ILCS 420/3)  (from Ch. 111 1/2, par. 2903)
8    Sec. 3. The powers and duties of the Department shall
9include the following:
10    (1) With the advice and counsel of the Committee, develop
11standards for determining eligibility for care and treatment
12under this program. Among other standards developed under this
13Section, persons suffering from hemophilia must be evaluated in
14a center properly staffed and equipped for such evaluation, but
15not operated by the Department.

1    (2) (Blank).
2    (3) Extend financial assistance to eligible persons in
3order that they may obtain blood and blood derivatives for use
4in hospitals, in medical and dental facilities, or at home. The
5Department shall extend financial assistance in each fiscal
6year to each family containing one or more eligible persons in
7the amount of (a) the family's eligible cost of hemophilia
8services for that fiscal year, minus (b) one fifth of its
9available family income for its next preceding taxable year.
10The Director may extend financial assistance in the case of
11unusual hardships, according to specific procedures and
12conditions adopted for this purpose in the rules and
13regulations promulgated by the Department to implement and
14administer this Act.
15    (3.5) Extend financial assistance to eligible persons to
16help subsidize the cost of health insurance premiums, including
17Medicare Part B premiums under the Medicare Buy-In process and
18continuation coverage premiums under the Consolidated Omnibus
19Budget Reconciliation Act of 1985 (COBRA). The assistance
20authorized by this item (3.5) shall only be available upon
21confirmation by the Department that such assistance is more
22cost effective than providing other assistance authorized
23under this Act.
