SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/6-19.5 new

    Amends the Election Code. Permits the dissolution of the board of election commissioners of a municipality with a population of less than 30,000 and the transfer of its authority and duties to the local election authority of the county in which the municipality is located, by referendum initiated by the registered voters of that county. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by adding Section
56-19.5 as follows:
 
6    (10 ILCS 5/6-19.5 new)
7    Sec. 6-19.5. Rejection of Article by county referendum.
8    (a) In addition to any other method of rejection provided
9in this Article, if the board of election commissioners of a
10municipality with a population of less than 30,000 is dissolved
11in accordance with subsection (b), the application of the
12provisions of this Article to that municipality is rejected.
13    (b) In a county with a population of less than 300,000, the
14board of election commissioners of a municipality with a
15population of less than 30,000 within that county may be
16dissolved, and the local election authority of that county may
17assume the authority and duties of the board of election
18commissioners of that municipality by a vote of the electors of
19the county. Upon the petition of 5,000 voters registered in the
20county to the circuit court to submit to the electors of the
21county the proposition to dissolve the board of election
22commissioners of the municipality and transfer its authority
23and duties to the local election authority of the county, the

1circuit court shall cause that proposition to be submitted to
2the electors of the county at the next possible general
3election. The proposition shall be submitted in the same manner
4as provided for the adoption of this Article and Articles 14
5and 18 of this Code, except that the question shall be stated:
6"Shall the board of election commissioners of
7................... be dissolved and the local election
8authority of ................... County assume the authority
9and duties of the board of election commissioners of
10...................?"
11    (c) Upon the adoption by the electors of the proposition to
12dissolve the board of election commissioners of the
13municipality and transfer its authority and duties to the local
14election authority of the county, or a reasonable period of
15time thereafter, the board of election commissioners of the
16municipality shall turn over to the local election authority of
17the county all registry books, registration record cards, poll
18books, tally sheets and ballot boxes, and all other books,
19forms, blanks, and stationery of every description in the
20board's possession in any way relating to elections or the
21holding of elections in the municipality. Thereupon, all
22functions, powers, and duties of the board of election
23commissioners of the municipality relating to elections in that
24municipality are transferred to the local election authority of
25the county.
 
26    Section 99. Effective date. This Act takes effect upon
