Amends the Illinois Pension Code. Adds a provision applicable to new hires that provides that an individual shall not be paid any of the benefits provided under the Code if he or she is convicted of a felony relating to, arising out of, or in connection with his or her service as a member or participant. Effective immediately.

1 | | AN ACT concerning public employee benefits.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pension Code is amended by adding |
5 | | Section 1-163 as follows: |
6 | | (40 ILCS 5/1-163 new) |
7 | | Sec. 1-163. Criminal conviction provision applicable to |
8 | | new hires. Notwithstanding any other provision of this Code, an |
9 | | individual who, on or after the effective date of this Section, |
10 | | first becomes a member or a participant under any retirement |
11 | | system or pension fund established under this Code shall not be |
12 | | paid any of the benefits provided under this Code if he or she |
13 | | is convicted of a felony relating to, arising out of, or in |
14 | | connection with his or her service as a member or participant. |
15 | | This Section shall not operate to impair any contract or |
16 | | vested right acquired before the effective date of this Code |
17 | | under any law or laws continued in this Code, and it shall not |
18 | | preclude the right to a refund.

19 | | Section 99. Effective date. This Act takes effect upon |
20 | | becoming law.
