AMENDMENT TO HOUSE BILL 2842

2    AMENDMENT NO. ______. Amend House Bill 2842, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Downstate Public Transportation Act is
6amended by changing Sections 2-15.2 and 2-15.3 as follows:
 
7    (30 ILCS 740/2-15.2)
8    Sec. 2-15.2. Free services; eligibility.
9    (a) Notwithstanding any law to the contrary, no later than
1060 days following the effective date of this amendatory Act of
11the 95th General Assembly and until subsection (b) is
12implemented, any fixed route public transportation services
13provided by, or under grant or purchase of service contracts
14of, every participant, as defined in Section 2-2.02 (1)(a),
15shall be provided without charge to all senior citizen
16residents of the participant aged 65 and older, under such

1conditions as shall be prescribed by the participant.
2    (b) Notwithstanding any law to the contrary, no later than
3180 days following the effective date of this amendatory Act of
4the 96th General Assembly, and until subsection (c) is
5implemented, any fixed route public transportation services
6provided by, or under grant or purchase of service contracts
7of, every participant, as defined in Section 2-2.02 (1)(a),
8shall be provided without charge to senior citizens aged 65 and
9older who meet the income eligibility limitation set forth in
10subsection (a-5) of Section 4 of the Senior Citizens and
11Disabled Persons Property Tax Relief Act, under such conditions
12as shall be prescribed by the participant. The Department on
13Aging shall furnish all information reasonably necessary to
14determine eligibility, including updated lists of individuals
15who are eligible for services without charge under this
16Section. Nothing in this Section shall relieve the participant
17from providing reduced fares as may be required by federal law.
18    (c) Notwithstanding any law to the contrary, beginning on
19the effective date of this amendatory Act of the 97th General
20Assembly, any fixed route public transportation services
21provided by, or under grant or purchase of service contracts
22of, every participant, as defined in Section 2-2.02 (1)(a),
23shall be provided without charge to senior citizens aged 65 and

8        (1) less than $27,610 for a household containing one
9    person;
10        (2) less than $36,635 for a household containing 2
11    persons; or
12        (3) less than $45,657 for a household containing 3 or
13    more persons.
14    Although eligibility for services under this subsection
15(c) is based on an assessment of household income, nothing in
16this subsection requires a participant to provide those
17services without charge to members of the qualifying senior
18citizen's household who are not also 65 years of age or older.
19    The Department of Revenue may adopt rules providing that
20the income eligibility limitations set forth in this subsection
21(c) may be changed to reflect the annual cost of living
22adjustment in Social Security and Supplemental Security Income
23benefits that are applicable to the year for which those
24benefits are reported as income on an application.

7of, the Board shall be provided without charge to all senior
8citizens of the Metropolitan Region (as such term is defined in
970 ILCS 3615/1.03) aged 65 and older, under such conditions as

11    (b) Notwithstanding any law to the contrary, no later than
12180 days following the effective date of this amendatory Act of
13the 96th General Assembly, and until subsection (c) is
14implemented, any fixed route public transportation services
15provided by, or under grant or purchase of service contracts
16of, the Board shall be provided without charge to senior
17citizens aged 65 and older who meet the income eligibility
18limitation set forth in subsection (a-5) of Section 4 of the

4by changing Sections 8.6 and 8.7 as follows:

13senior citizens of the District aged 65 and older, under such
14conditions as shall be prescribed by the District.
15    (b) Notwithstanding any law to the contrary, no later than
16180 days following the effective date of this amendatory Act of
17the 96th General Assembly, and until subsection (c) is
18implemented, any fixed route public transportation services
19provided by, or under grant or purchase of service contracts
20of, every District shall be provided without charge to senior
21citizens aged 65 and older who meet the income eligibility
22limitation set forth in subsection (a-5) of Section 4 of the
23Senior Citizens and Disabled Persons Property Tax Relief Act,

7eligibility limitation set forth in subsection (a-5) of Section
84 of the Senior Citizens and Disabled Persons Property Tax
9Relief Act, under such conditions as shall be prescribed by the
10Suburban Bus Board. The Department on Aging shall furnish all
11information reasonably necessary to determine eligibility,
12including updated lists of individuals who are eligible for
13services without charge under this Section. Nothing in this
14Section shall relieve the Suburban Bus Board from providing
15reduced fares as may be required by federal law.
16    (c) Notwithstanding any law to the contrary, beginning on
17the effective date of this amendatory Act of the 97th General
18Assembly, any fixed route public transportation services
19provided by, or under grant or purchase of service contracts
20of, the Suburban Bus Board shall be provided without charge to
21senior citizens aged 65 and older who meet the income
22eligibility limitation set forth in this subsection (c), under
23such conditions as shall be prescribed by the Suburban Bus

14eligibility limitation set forth in subsection (a-5) of Section

16Relief Act, under such conditions as shall be prescribed by the

7    Sec. 3B.15. Transit services for disabled individuals.
8    (a) Notwithstanding any law to the contrary, no later than
960 days following the effective date of this amendatory Act of
10the 95th General Assembly, and until subsection (b) is
11implemented, all fixed route public transportation services
12provided by, or under grant or purchase of service contract of,
13the Commuter Rail Board shall be provided without charge to all
14disabled persons who meet the income eligibility limitation set
15forth in subsection (a-5) of Section 4 of the Senior Citizens
16and Disabled Persons Property Tax Relief Act, under such
17procedures as shall be prescribed by the Board. The Department
18on Aging shall furnish all information reasonably necessary to
19determine eligibility, including updated lists of individuals
20who are eligible for services without charge under this
21Section.
22    (b) Notwithstanding any law to the contrary, beginning on
23the effective date of this amendatory Act of the 97th General
24Assembly, all fixed route public transportation services

1the Commuter Rail Board shall be provided without charge to all
2disabled persons who meet the income eligibility limitation set
3forth in this subsection (b), under such procedures as shall be
4prescribed by the Board. The Department of Revenue shall
5furnish all information reasonably necessary to determine
6eligibility, including updated lists of individuals who are
7eligible for services without charge under this Section.
8    For purposes of this subsection (b), the income eligibility
9limitation is as follows:
10        (1) less than $27,610 for a household containing one
11    person;
12        (2) less than $36,635 for a household containing 2
13    persons; or
14        (3) less than $45,657 for a household containing 3 or
15    more persons.
16    Although eligibility for services under this subsection
17(b) is based on an assessment of household income, nothing in
18this subsection requires the Commuter Rail Board to provide
19those services without charge to members of the disabled
20person's household who are not also disabled.
21    The Department of Revenue may adopt rules providing that
22the income eligibility limitations set forth in this subsection
23(b) may be changed to reflect the annual cost of living
24adjustment in Social Security and Supplemental Security Income
25benefits that are applicable to the year for which those
26benefits are reported as income on an application.

2    Section 25. The Illinois Vehicle Code is amended by
3changing Section 3-691 as follows:
 
4    (625 ILCS 5/3-691)
5    Sec. 3-691. Illinois Fraternal Order of Police license
6plates.
7    (a) The Secretary, upon receipt of an application made in
8the form prescribed by the Secretary, may issue special
9registration plates designated as Illinois Fraternal Order of
10Police license plates to residents of Illinois who are members
11in good standing of the Fraternal Order of Police-Illinois
12State Lodge and meet other eligibility requirements prescribed
13by the Secretary of State. The special plates issued under this
14Section shall be affixed only to passenger vehicles of the
15first division and motor vehicles of the second division
16weighing not more than 8,000 pounds, and recreational vehicles,
17as defined by Section 1-169 of this Code. Plates issued under
18this Section shall expire according to the multi-year procedure
19established by Section 3-414.1 of this Code. The Secretary of
20State shall verify that an applicant for registration renewal
21remains a member in good standing of the Fraternal Order of
22Police - Illinois State Lodge prior to renewing the
23registration.
24    (b) The design and color of the plates is wholly within the

1discretion of the Secretary, except that the Illinois Fraternal
2Order of Police emblem shall appear on the plates. The
3Secretary may allow the plates to be issued as vanity plates or
4personalized under Section 3-405.1 of the Code. The Secretary
5shall prescribe stickers or decals as provided under Section
63-412 of this Code. The plates are not required to designate
7"Land of Lincoln" as prescribed in subsection (b) of Section
83-412 of this Code. The Secretary may, in his or her
9discretion, allow the plates to be issued as vanity or
10personalized plates in accordance with Section 3-405.1 of this
11Code.
12    (c) An applicant for the special plate shall be charged a
13$25 fee for original issuance in addition to the appropriate
14registration fee. Of this fee, $10 shall be deposited into the
15Fraternal Order of Police Fund and $15 shall be deposited into
16the Secretary of State Special License Plate Fund, to be used
17by the Secretary to help defray the administrative processing
18costs.
19    For each registration renewal period, a $25 fee, in
20addition to the appropriate registration fee, shall be charged.
21Of this fee, $23 shall be deposited into the Fraternal Order of
22Police Fund and $2 shall be deposited into the Secretary of
23State Special License Plate Fund.
24    (d) The Fraternal Order of Police Fund is created as a
25special fund in the State treasury. All money in the Fraternal
26Order of Police Fund shall be paid, subject to appropriation by

1the General Assembly and distribution by the Secretary, as
2grants to the Illinois Fraternal Order of Police to increase
3the efficiency and professionalism of law enforcement officers
4in Illinois, to educate the public about law enforcement
5issues, to more firmly establish the public confidence in law
6enforcement, to create partnerships with the public, and to
7honor the service of law enforcement officers dedicated to the
8protection of life and property.

10    Section 99. Effective date. This Act takes effect January
111, 2014, except that Section 25 takes effect upon becoming
12law.".
