SYNOPSIS AS INTRODUCED:
 
735 ILCS 5/Art. VIII Pt. 29 heading new
735 ILCS 5/8-2901 new

    Amends the Code of Civil Procedure. Provides that evidence of speed based on a laser speed detection device obtained by using a model approved by the Department of State Police shall be considered scientifically acceptable and reliable as a speed detection device and is admissible for all purposes in any court or administrative proceeding. Provides that a certified copy of the Department of State Police list of approved models of such laser devices is self authenticating and admissible for all purposes in any court or administrative proceeding. Effective immediately.

1     AN ACT concerning civil law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Civil Procedure is amended by adding
5 Part 29 to Article VIII as follows:
 
6     (735 ILCS 5/Art. VIII Pt. 29 heading new)

Part 29. Speed Detection Device.

 
8     (735 ILCS 5/8-2901 new)
9     Sec. 8-2901. Admissibility of evidence; laser speed
10 detection device. Evidence of speed based on a speed detection
11 device using the speed timing principle of laser which is of a
12 model that has been approved by the Department of State Police
13 shall be considered scientifically acceptable and reliable as a
14 speed detection device and shall be admissible for all purposes
15 in any court or administrative proceeding in this State. A
16 certified copy of the Department of State Police of approved
17 models of such laser devices shall be self-authenticating and
18 shall be admissible for all purposes in any court or
19 administrative proceeding in this State.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
