AMENDMENT TO SENATE BILL 3496

2     AMENDMENT NO. ______. Amend Senate Bill 3496 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by adding Section
5 5-1071.2 as follows:
 
6     (55 ILCS 5/5-1071.2 new)
7     Sec. 5-1071.2. Barking dogs. The county board of each
8 county may, by ordinance, regulate and prohibit the ownership,
9 keeping, possession, or harboring of dogs that by frequent or
10 habitual howling, yelping, barking, or otherwise cause
11 annoyance or disturbance to the surrounding neighborhood
12 within an unincorporated area of the county that has been
13 subdivided for residential purposes. The ordinance must
14 require that the dog was either (i) left outside of a residence
15 without an owner or caretaker, as those terms are used in the
16 Animal Control Act, on the property or (ii) left outside of a

1 residence and the owner or caretaker was present on the
2 property but the owner or caretaker did not take remedial
3 action to cease the annoyance or disturbance to the surrounding
4 neighborhood. The county board may impose such fines or
5 penalties as are deemed proper to effectuate the purposes of
6 this Section, except when a fine or penalty is already allowed
7 by law. This Section does not apply to veterinary hospitals or
8 clinics operated by a veterinarian licensed under the
9 Veterinary Medicine and Surgery Practice Act of 2004 or
10 premises occupied or used by a county pound.
11     For the purposes of this Section, "surrounding
12 neighborhood" means the property upon which the violating dog
13 is causing the annoyance or disturbance and all properties
14 within 500 feet of that property.
 
15     Section 99. Effective date. This Act takes effect upon
16 becoming law.".
