1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 9-3-1.5 as follows:
 
6     (720 ILCS 5/9-3-1.5 new)
7     Sec. 9-3-1.5. Concealment of death.
8     (a) For purposes of this Section, "conceal" means the
9 performing of some act or acts for the purpose of preventing or
10 delaying the discovery of a death. "Conceal" means something
11 more than simply withholding knowledge or failing to disclose
12 information.
13     (b) A person commits the offense of concealment of death
14 when he or she knowingly conceals the death of any other person
15 who died by other than homicidal means.
16     (c) A person commits the offense of concealment of death
17 when he or she knowingly moves the body of a dead person from
18 its place of death, with the intent of concealing information
19 regarding the place or manner of death of that person, or the
20 identity of any person with information regarding the death of
21 that person. This subsection shall not apply to any movement of
22 the body of a dead person by medical personnel, fire fighters,
23 law enforcement officers, coroners, medical examiners, or

1 licensed funeral directors, or by any person acting at the
2 direction of medical personnel, fire fighters, law enforcement
3 officers, coroners, medical examiners, or licensed funeral
4 directors.
5     (d) Sentence. Concealment of death is a Class 4 felony.
