AMENDMENT TO SENATE BILL 2556

2     AMENDMENT NO. ______. Amend Senate Bill 2556 as follows:
 
3 on page 2, by replacing lines 1 through 9 with the following:
4 "Prevention District Act; provided, however, that an area that
5 lies within a flood prevention district established in
6 accordance with the Flood Prevention District Act shall be
7 deemed by operation of law to be within the 100-year floodplain
8 if, according to the currently adopted federal flood insurance
9 rate map, the area is subject to inundation by a 100-year flood
10 from bodies of water other than the Mississippi River."; and
 
11 on page 3, by replacing lines 3 through 10 with the following:
12 "Act; provided, however, that an area that lies within a flood
13 prevention district established in accordance with the Flood
14 Prevention District Act shall be deemed by operation of law to
15 be within the 100-year floodplain if, according to the
16 currently adopted federal flood insurance rate map, the area is

1 subject to inundation by a 100-year flood from bodies of water
2 other than the Mississippi River."; and
 
3 on page 3, line 12, by replacing "Section 18h" with "Sections
4 18h, 18i, and 18j"; and
 
5 on page 5, by replacing lines 17 through 24, with the
6 following:
7 "District Act; provided, however, that an area that lies within
8 a flood prevention district established in accordance with the
9 Flood Prevention District Act shall be deemed by operation of
10 law to be within the 100-year floodplain if, according to the
11 currently adopted federal flood insurance rate map, the area is
12 subject to inundation by a 100-year flood from bodies of water
13 other than the Mississippi River."; and
 
14 on page 9, immediately below line 16, by inserting the
15 following:
 
16     "(615 ILCS 5/18i new)
17     Sec. 18i. Maintenance of eligibility to participate in the
18 National Flood Insurance Program. Nothing in this amendatory
19 Act of the 96th General Assembly shall be construed to diminish
20 or conflict with the authority and the obligation of local
21 governments to adopt and enforce local ordinances and
22 regulations necessary to maintain eligibility to participate

1 fully in the National Flood Insurance Program and for property
2 owners to purchase federal flood insurance. A local government
3 located in an area that is (i) protected by a federal levee and
4 (ii) located in a flood prevention district established in
5 accordance with the Flood Prevention District Act must adopt
6 and maintain ordinances and floodplain management regulations
7 that meet the requirements of 44 C.F.R. 60.3, 60.4, and 60.5,
8 and it must submit copies of those documents to the Federal
9 Emergency Management Agency as required by federal law.

11     Sec. 18j. ESDA critical facility evacuation plans. Any
12 critical facility that gives shelter to a person who would be
13 unable to evacuate without assistance during a flooding event,
14 and that is located in an area deemed by operation of law not
15 to be within the 100-year floodplain because the area in which
16 the critical facility is located lies within an area protected
17 by a federal levee and is located in a flood prevention
18 district established in accordance with the Flood Prevention
19 District Act shall develop an evacuation plan and certify to
20 the Emergency Services and Disaster Agency (ESDA), as defined
21 by Section 4 of the Illinois Emergency Management Act, on a
22 form provided by the ESDA, that it has developed an evacuation
23 plan which the critical facility has or will implement prior to
24 or concurrent with occupancy of the facility to evacuate
25 persons who need assistance evacuating the facility and the
