SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Fair Athletic Competition Act. Requires the Illinois High School Association (IHSA), in conjunction with its Sports Medicine Advisory Committee, to develop and implement a program of random testing for steroids of individual athletes participating in interscholastic athletic programs under IHSA's purview. Provides that any student who possesses, ingests, or otherwise uses any substance on the IHSA list of banned substances, without a prescription by a fully licensed physician to treat a medical condition, shall be considered in violation of IHSA's by-laws and is subject to penalties approved by the IHSA Board of Directors. Sets forth what these penalties must include. Provides that a student athlete who refuses to consent to testing is not eligible for interscholastic competition and shall immediately forfeit his or her eligibility to participate in interscholastic competition for 365 days. Provides for confidentiality of test results. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Fair
5 Athletic Competition Act.
 
6     Section 5. Definition. "IHSA" means the Illinois High
7 School Association.
 
8     Section 10. Random testing for steroids program. The IHSA,
9 in conjunction with its Sports Medicine Advisory Committee,
10 shall develop and implement a program of random testing for
11 steroids of individual athletes participating in
12 interscholastic athletic programs under IHSA's purview. The
13 program shall commence with the 2009-2010 school year. The IHSA
14 Board of Directors shall select the sports to be randomly
15 tested and shall select a certified laboratory to administer
16 the tests.
 
17     Section 15. Student use of banned substance. Any student
18 who possesses, ingests, or otherwise uses any substance on the
19 IHSA list of banned substances, without a prescription by a
20 fully licensed physician to treat a medical condition, shall be
21 considered in violation of IHSA's by-laws and is subject to

1 penalties approved by the IHSA Board of Directors. Penalties
2 must include a period of ineligibility not to exceed 365 days
3 and counseling.
 
4     Section 20. Refusal to take test. A student athlete who
5 refuses to consent to testing under this Act is not eligible
6 for interscholastic competition. A student athlete who refuses
7 to take the test shall immediately forfeit his or her
8 eligibility to participate in interscholastic competition for
9 365 days.
 
10     Section 25. Confidentiality. Results of all tests
11 administered under the authority of this Act shall be
12 considered confidential and may be disclosed only to the
13 student, his or her parents, and the school.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
