AMENDMENT TO SENATE BILL 1980

2     AMENDMENT NO. ______. Amend Senate Bill 1980 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by adding Section
5 5-1131 as follows:
 
6     (55 ILCS 5/5-1131 new)
7     Sec. 5-1131. Fire sprinklers. A county board shall not
8 adopt a code provision or ordinance that prohibits a person or
9 entity from installing or equipping fire sprinklers in a single
10 family detached residence or any residential building that
11 contains not more than 2 dwelling units unless that code
12 provision or ordinance is considered by the county board in a
13 vote separate from any other code provision or ordinance. A
14 county board shall not adopt a code provision or ordinance that
15 requires a person or entity to install or equip fire sprinklers
16 in a single family detached residence or any residential

1 building that contains not more than 2 dwelling units unless
2 that code provision or ordinance is considered by the county
3 board in a vote separate from any other code provision or
4 ordinance. This Section does not apply to any code provision or
5 ordinance that requires fire sprinklers in a residence that was
6 adopted before December 31, 2008.
 
7     Section 10. The Illinois Municipal Code is amended by
8 adding Section 1-2-13 as follows:
 
9     (65 ILCS 5/1-2-13 new)
10     Sec. 1-2-13. Fire sprinklers. The corporate authorities of
11 a municipality shall not adopt a code provision or ordinance
12 that prohibits a person or entity from installing or equipping
13 fire sprinklers in a single family detached residence or any
14 residential building that contains not more than 2 dwelling
15 units unless that code provision or ordinance is considered by
16 the corporate authorities of a municipality in a vote separate
17 from any other code provision or ordinance. The corporate
18 authorities of a municipality shall not adopt a code provision
19 or ordinance that requires a person or entity to install or
20 equip fire sprinklers in a single family detached residence or
21 any residential building that contains not more than 2 dwelling
22 units unless that code provision or ordinance is considered by
23 the corporate authorities of a municipality in a vote separate
24 from any other code provision or ordinance. This Section does

1 not apply to any code provision or ordinance that requires fire
2 sprinklers in a residence that was adopted before December 31,
3 2008.
 
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.".
