SYNOPSIS AS INTRODUCED:

65 ILCS 5/1-2-13 new

    Amends the Counties Code and the Illinois Municipal Code. Provides that a county board or the corporate authorities of a municipality shall not adopt a code or ordinance that (i) prohibits a person or entity from installing or equipping fire sprinklers in specified residences or (ii) requires a person or entity to install or equip fire sprinklers in specified residences. Provides that a county board or the corporate authorities of a municipality shall not impose any fine, penalty, or other requirement on any person or entity for installing or equipping or not installing or equipping fire sprinklers in specified residences. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-1131 as follows:
 
6     (55 ILCS 5/5-1131 new)
7     Sec. 5-1131. Fire sprinklers. A county board shall not
8 adopt a code or ordinance that prohibits a person or entity
9 from installing or equipping fire sprinklers in a single family
10 detached residence or any residential building that contains
11 not more than 2 dwelling units. A county board shall not adopt
12 a code or ordinance that requires a person or entity to install
13 or equip fire sprinklers in a single family detached residence
14 or any residential building that contains not more than 2
15 dwelling units. A county board shall not impose any fine,
16 penalty, or other requirement on any person or entity for
17 installing or equipping or not installing or equipping fire
18 sprinklers in such residence. This Section does not apply to
19 any code or ordinance that requires fire sprinklers in a
20 residence that was adopted before December 31, 2009.
 
21     Section 10. The Illinois Municipal Code is amended by
22 adding Section 1-2-13 as follows:

16 that requires fire sprinklers in a residence that was adopted
17 before December 31, 2009.
 
18     Section 99. Effective date. This Act takes effect upon
19 becoming law.
