AMENDMENT TO SENATE BILL 1654

2     AMENDMENT NO. ______. Amend Senate Bill 1654, on page 1,
3 line 5, by replacing "and 7.16" with "7.16, and 7.17"; and
 
4 by replacing line 21 on page 1 through line 1 on page 2 with the
5 following:
6 "operation and administration. The the entire net proceeds of
7 the Lottery which are to be used for the support of the State's
8 Common School Fund, except as provided in Sections 21.2, 21.5,
9 21.6, 21.7, and 21.8."; and
 
10 on page 2, line 8, after "competitive process", by inserting
11 "in accordance with the Illinois Procurement Code"; and
 
12 on page 2, by replacing line 18 with the following:
13 "the purposes of this Act.
14     The competitive process followed by the State shall take
15 into account the third party's ability to:

1         (1) market the Lottery to those residents who are not
2     currently regular players of the Lottery, paying
3     particular attention to those who are most likely to make
4     regular purchases on the Internet;
5         (2) address the State's concern with the social effects
6     of gambling on those who can least afford to do so; and
7         (3) provide the most successful management of the
8     Lottery for the benefit of the people of the State of
9     Illinois based on current and past business practices or
10     plans of the third party.
11     The Lottery shall remain, for so long"; and
 
12 on page 3, by replacing line 12 with the following:
13     "Sec. 7.12. Internet pilot program. The General Assembly
14 finds that:
15         (1) the consumer market in Illinois has changed since
16     the creation of the Illinois State Lottery in 1974;
17         (2) the Internet has become an integral part of
18     everyday life for a significant number of Illinois
19     residents not only in regards to their professional life,
20     but also in regards to personal business and communication;
21     and
22         (3) the current practices of selling lottery tickets
23     does not appeal to the new form of market participants who
24     prefer to make purchases on the internet at their own
25     convenience.

1     It is the intent of the General Assembly to create an
2 Internet pilot program for the sale of lottery tickets to
3 capture this new form of market participant.
4     The Department shall"; and
 
5 on page 3, line 17, by replacing "program. The" with "program.
6 These rules shall include requirements for marketing of the
7 Lottery to infrequent players. The"; and
 
8 on page 4, by deleting lines 19 through 23; and
 
9 on page 5, line 4, by replacing "an" with "one"; and
 
10 on page 5, line 6, after the period, by inserting
11 "Non-residents of Illinois shall only be allowed to participate
12 in the pilot program if the federal Department of Justice
13 indicates that it is legal for non-residents to do so."; and
 
14 on page 5, line 10, after the period, by inserting "If any
15 participant in the pilot program violates any of provisions of
16 this amendatory Act of the 96th General Assembly or rule
17 established by the Department, all such winnings shall be
18 forfeited. Such forfeited winnings shall be deposited in the
19 Common School Fund."; and
 
20 on page 5, by replacing lines 11 through 22 with the following:

1     "(20 ILCS 1605/7.16 new)
2     Sec. 7.16. Voluntary self-exclusion program for Internet
3 lottery sales. Any resident, or non-resident if allowed to
4 participate in the pilot program, may voluntarily prohibit
5 themselves from establishing an Internet lottery account. The
6 Department shall incorporate the voluntary self-exclusion
7 program for Internet lottery accounts into any existing
8 self-exclusion program that they currently operate.
 
9     (20 ILCS 1605/7.17 new)
10     Sec. 7.17. Contracts. The contract with a private vendor
11 to fulfill the program requirements must be separate from
12 lottery contracts existing on the effective date of this
13 Section.
14     All contracts entered into (i) with a private vendor to
15 fulfill the requirements for the pilot program under Section
16 7.12 or (ii) for the development and provision of technology
17 and controls under this Section shall be subject to competitive
18 bidding in accordance with the Illinois Procurement Code.
19     The Department shall award contracts for the development
20 and provision of technology and controls to ensure compliance
21 with the age and residency requirements for the purchase of
22 lottery tickets on the Internet pursuant to competitive bidding
23 processes. The technology and controls must include
24 appropriate data security standards to prevent unauthorized

1 access to Internet lottery accounts.".
