SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-303   from Ch. 95 1/2, par. 3-303
625 ILCS 5/3-304   from Ch. 95 1/2, par. 3-304

    Amends the Illinois Vehicle Code. Requires applicants for a certificate of title for a rebuilt vehicle that have personally rebuilt or supervised the rebuild of the vehicle to sign a written affirmation stating that the applicant is a licensed rebuilder (rather than providing no requirement that the applicant to be a licensed rebuilder). Provides that if an applicant for certificate of title for a rebuilt vehicle has contracted with a licensed rebuilder for the rebuild of the vehicle, a copy of the contract and a statement from the rebuilder, in a form designated by the Secretary of State, certifying that all of the supporting documentation and the contents of the application for certificate of title are, to the best of the rebuilder's knowledge and belief, complete, true, and correct are required to complete the application. Effective January 1, 2010.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-303 and 3-304 as follows:
 
6     (625 ILCS 5/3-303)  (from Ch. 95 1/2, par. 3-303)
7     Sec. 3-303. Application for title - attachments. Every
8 application for a certificate of title for a rebuilt vehicle
9 shall be accompanied by the following:
10     1. The salvage certificate or out-of-state title
11 certificate previously issued for the rebuilt vehicle;
12     2. Bills of sale and other documents evidencing the
13 acquisition of all essential parts used to rebuild the vehicle;
14     3. Photographs of the rebuilt vehicle if required by rule
15 of the Secretary of State;
16     4. A Certificate of Safety furnished by the Department of
17 Transportation as set forth in Section 13-109; and
18     5. A listing of all replaced essential parts of the rebuilt
19 vehicle, and the identification number of the vehicle or
20 vehicles from which the essential parts originated; and .
21     6. Where the party has contracted for the rebuilding of the
22 vehicle pursuant to Section 3-304, a copy of the contract and
23 the form executed by the rebuilder.

3     Sec. 3-304. Application for title - affirmation.
4     (a) The applicant applying for a certificate of title for a
5 rebuilt vehicle shall sign a written affirmation which states
6 the following:
7     1. The applicant He
8         (A) is a licensed rebuilder and personally rebuilt the
9     vehicle; ,
10         (B) is a licensed builder and personally supervised its
11     rebuilding ; or
12         (C) contracted for rebuilding with a licensed
13     rebuilder;
14     2. The applicant He personally inspected the completed
15 vehicle, and it complies with all safety requirements set forth
16 in this Code and any regulations promulgated thereunder by the
17 Secretary of State;
18     3. The identification numbers of the rebuilt vehicle and
19 its parts have not, to the knowledge of the applicant, been
20 removed, destroyed, falsified, altered or defaced;
21     4. The salvage certificate or out-of-state title
22 certificate attached to the application has not, to the
23 knowledge of the applicant, been forged, falsified, altered or
24 counterfeited; and
25     5. All information contained on the application and its

1 attachments is true and correct to the knowledge of the
2 applicant.
3     (b) If the applicant states that he or she has contracted
4 for rebuilding with a licensed rebuilder, the applicant shall
5 submit a statement from the rebuilder, in the form designated
6 by the Secretary, stating that all of the supporting
7 documentation and the contents of the application are, to the
8 best of the rebuilder's knowledge and belief, complete, true,
9 and correct.

11     Section 99. Effective date. This Act takes effect January
12 1, 2010.
