AMENDMENT TO SENATE BILL 1449

2     AMENDMENT NO. ______. Amend Senate Bill 1449 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the Free
5 Healthcare Benefits Application Assistance Act.
 
6     Section 5. Healthcare program application assistance. It
7 is a Class C misdemeanor for any person, including an
8 individual, firm, corporation, association, partnership, joint
9 venture, or any employee or agent thereof, to charge another
10 person for assisting in completing and submitting an
11 application for enrollment in any means-tested healthcare
12 program administered by the Department of Healthcare and Family
13 Services.
14     Nothing in this Act shall be construed as prohibiting a
15 person or other entity from receiving payment from the
16 Department of Healthcare and Family Services or other State

1 agency for assisting persons in applying for healthcare
2 benefits.
 
3     Section 10. The Covering ALL KIDS Health Insurance Act is
4 amended by changing Section 25 as follows:
 
5     (215 ILCS 170/25)
6     (Section scheduled to be repealed on July 1, 2011)
7     Sec. 25. Enrollment in Program. The Department shall
8 develop procedures to allow application agents to assist in
9 enrolling children in the Program or other children's health
10 programs operated by the Department. At the Department's
11 discretion, technical assistance payments may be made
12 available for approved applications facilitated by an
13 application agent. The Department shall permit day and
14 temporary labor service agencies, as defined in the Day and
15 Temporary Labor Services Act and doing business in Illinois, to
16 enroll as unpaid application agents. As established in the Free
17 Healthcare Benefits Application Assistance Act, it shall be
18 unlawful for any person to charge another person or family for
19 assisting in completing and submitting an application for
20 enrollment in this Program.

22     Section 99. Effective date. This Act takes effect upon
23 becoming law.".
