1     AN ACT concerning insurance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Free
5 Healthcare Benefits Application Assistance Act.
 
6     Section 5. Healthcare program application assistance. It
7 is a Class C misdemeanor for any person, including an
8 individual, firm, corporation, association, partnership, joint
9 venture, or any employee or agent thereof, to charge another
10 person for assisting in completing and submitting an
11 application for enrollment in any means-tested healthcare
12 program administered by the Department of Healthcare and Family
13 Services.
14     Nothing in this Act shall be construed as prohibiting a
15 person or other entity from receiving payment from the
16 Department of Healthcare and Family Services or other State
17 agency for assisting persons in applying for healthcare
18 benefits.
 
19     Section 10. The Covering ALL KIDS Health Insurance Act is
20 amended by changing Section 25 as follows:

1     (Section scheduled to be repealed on July 1, 2011)
2     Sec. 25. Enrollment in Program. The Department shall
3 develop procedures to allow application agents to assist in
4 enrolling children in the Program or other children's health
5 programs operated by the Department. At the Department's
6 discretion, technical assistance payments may be made
7 available for approved applications facilitated by an
8 application agent. The Department shall permit day and
9 temporary labor service agencies, as defined in the Day and
10 Temporary Labor Services Act and doing business in Illinois, to
11 enroll as unpaid application agents. As established in the Free
12 Healthcare Benefits Application Assistance Act, it shall be
13 unlawful for any person to charge another person or family for
14 assisting in completing and submitting an application for
15 enrollment in this Program.

17     Section 99. Effective date. This Act takes effect upon
18 becoming law.
