SYNOPSIS AS INTRODUCED:
 
New Act
30 ILCS 105/5.719 new

    Creates the Live Music Illinois Act. Creates the Live Music Illinois Board. Provides that the Board shall consist of 5 members. Specifies the Board's powers and duties. Establishes the Live Music Illinois Fund as a special fund in the State treasury. Requires monthly transfers from the GRF to the Fund in the amount of $208,334 until $12,500,000 has been transferred. Provides that moneys in the Fund shall be used by the Board to issue grants to units of local government and community groups for musical performances by eligible musicians and musical ensembles. Provides that moneys in the Fund shall also be used to issue grants to eligible musicians and musical ensembles for musical performances. Provides that the musical performances must be free and open to the public. Imposes conditions on any rulemaking authority. Amends the State Finance Act to create the Fund. Effective July 1, 2009.

1     AN ACT concerning music.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Live
5 Music Illinois Act.
 
6     Section 5. Purpose. It is the purpose of this Act to
7 annually provide free and live musical events or programs, in a
8 variety of styles and configurations, to the people of the
9 State of Illinois. The musical events or programs must be free
10 of charge and open to the public. The purpose of this Act is to
11 annually present between 200 to 250 free musical events or
12 programs to inspire and educate children and to enrich the
13 lives of all Illinois citizens.
 
14     Section 10. Live Music Illinois Board.
15     (a) Members. The Live Music Illinois Board is established
16 to govern the application for and distribution of funds from
17 the Live Music Illinois Fund. The Board shall consist of 5
18 members appointed by the Governor. Members of the Board must be
19 Illinois citizens and demonstrate a knowledge of and an
20 interest in live music programs. At least 2 appointees to the
21 Board must be members of the American Federation of Musicians.
22     (b) Reimbursement. Board members may be reimbursed for the

1 cost of reasonable expenses incurred in the performance of
2 Board duties. Board members shall not receive a salary.
 
3     Section 15. Powers and duties of the Board.
4     (a) Powers and duties. The Live Music Illinois Board shall
5 establish rules regarding the criteria and process for grant
6 applications. Board members shall seek to raise money to
7 support the Fund and pursue co-sponsors for musical events and
8 programs. The Board may hire an administrator and office staff
9 to assist in the performance of the Board's duties. The Board
10 shall determine a reasonable compensation for the
11 administrator and office staff.
12     (b) Rulemaking conditions. Rulemaking authority to
13 implement this Act, if any, is conditioned on the rules being
14 adopted in accordance with all provisions of the Illinois
15 Administrative Procedure Act and all rules and procedures of
16 the Joint Committee on Administrative Rules; any purported rule
17 not so adopted, for whatever reason, is unauthorized.
 
18     Section 20. The Live Music Illinois Fund. The Live Music
19 Illinois Fund is created as a special fund in the State
20 treasury.
21     Beginning July 1, 2009 or as soon thereafter as practical,
22 the Comptroller shall order transferred and the Treasurer shall
23 monthly transfer $208,334 from the General Revenue Fund to the
24 Live Music Illinois Fund until the total aggregate amount

1 transferred is $12,500,000.
2     The Live Music Illinois Board may accept gifts, grants,
3 donations, appropriations, and other amounts from any legal
4 source for deposit into the Fund.
5     Money in the Fund shall, pursuant to appropriation, be used
6 by the Live Music Illinois Board to (i) award grants to units
7 of local government and community groups for musical
8 performances by eligible musicians and musical ensembles, (ii)
9 award grants to eligible musicians and musical ensembles for
10 musical performances, and (iii) implement and administer this
11 Act.
 
12     Section 25. Eligible musicians and music ensembles.
13 Musicians and musical ensembles must apply to the Live Music
14 Illinois Board and be deemed eligible by the Board to perform
15 at a Live Music Illinois event or program.
 
16     Section 30. The State Finance Act is amended by adding
17 Section 5.719 as follows:

19     Sec. 5.719. The Live Music Illinois Fund.
 
20     Section 99. Effective date. This Act takes effect July 1,
21 2009.
