AMENDMENT TO SENATE BILL 918

2     AMENDMENT NO. ______. Amend Senate Bill 918 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Wildlife Code is amended by changing
5 Section 3.22 as follows:
 
6     (520 ILCS 5/3.22)  (from Ch. 61, par. 3.22)
7     Sec. 3.22. Issuance of scientific and special purpose
8 permits. Scientific permits Permits may be granted by the
9 Department to any properly accredited person at least 18 years
10 of age, permitting the capture, marking, handling, banding, or
11 collecting (including fur, hide, skin, teeth, feathers, claws,
12 nests, eggs, or young), for strictly scientific purposes, of
13 any of the fauna now protected under this Code. A special
14 purpose salvage permit may be granted to qualified individuals
15 at least 15 years of age for the purpose of salvaging dead,
16 sick, orphaned, or crippled wildlife species protected by this

1 Act for permanent donation to bona fide public or state
2 scientific, educational or zoological institutions or, for the
3 purpose of rehabilitation and subsequent release to the wild,
4 or other disposal as directed by the Department. Private
5 educational organizations may be granted a special purpose
6 permit to possess wildlife or parts thereof for educational
7 purposes. A special purpose permit is required prior to
8 treatment, administration, or both of any wild fauna protected
9 by this Code that is captured, handled, or both in the wild or
10 will be released to the wild with any type of chemical or other
11 compound (including but not limited to vaccines, inhalants,
12 medicinal agents requiring oral or dermal application)
13 regardless of means of delivery, except that individuals and
14 organizations removing or destroying wild birds and wild
15 mammals under Section 2.37 of this Code or releasing game birds
16 under Section 3.23 of this Code are not required to obtain
17 those special purpose permits. Treatment under this special
18 purpose permit means to effect a cure or physiological change
19 within the animal. The Department shall set forth applicable
20 regulations in an administrative rule covering qualifications
21 and facilities needed to obtain both a scientific and a special
22 purpose permit. The application for these permits such a permit
23 shall be approved by the Department to determine if a permit
24 should be issued. Disposition of fauna taken under the
25 authority of this Section shall be specified by the Department.
26     The holder of each such scientific or special purpose

1 permit shall make to the Department, within 30 days after the
2 expiration of his or her permit, a report in writing upon
3 blanks furnished by the Department. Such reports shall be made
4 (i) annually if the permit is granted for a period of more than
5 one year or (ii) within 30 days after the expiration of the
6 permit if the permit is granted for a period of one year or
7 less. Such reports shall include report shall show the name and
8 address of all persons from whom specimens were received, the
9 kinds of specimens taken, disposition made of same, and any
10 other information which the Department may consider necessary.

12     Section 99. Effective date. This Act takes effect upon
13 becoming law.".
