1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Procurement Code is amended by
5 changing Section 20-80 as follows:
 
6     (30 ILCS 500/20-80)
7     Sec. 20-80. Contract files.
8     (a) Written determinations. All written determinations
9 required under this Article shall be placed in the contract
10 file maintained by the chief procurement officer.
11     (b) Filing with Comptroller. Whenever a grant, defined
12 pursuant to accounting standards established by the
13 Comptroller, or a contract liability, except for: (1) contracts
14 paid from personal services, or (2) contracts between the State
15 and its employees to defer compensation in accordance with
16 Article 24 of the Illinois Pension Code, exceeding $10,000 is
17 incurred by any State agency, a copy of the contract, purchase
18 order, grant, or lease shall be filed with the Comptroller
19 within 15 days thereafter. Any cancellation or modification to
20 any such contract liability shall be filed with the Comptroller
21 within 15 days of its execution. For each State contract
22 awarded on or after the effective date of this amendatory Act
23 of the 96th General Assembly that includes goods or supplies,

1 the Comptroller shall publish on his or her official website
2 the rate per metric unit of each of the goods or supplies,
3 provided that the information required to publish the rate is
4 not considered proprietary competitive information.
5     (c) Late filing affidavit. When a contract, purchase order,
6 grant, or lease required to be filed by this Section has not
7 been filed within 30 days of execution, the Comptroller shall
8 refuse to issue a warrant for payment thereunder until the
9 agency files with the Comptroller the contract, purchase order,
10 grant, or lease and an affidavit, signed by the chief executive
11 officer of the agency or his or her designee, setting forth an
12 explanation of why the contract liability was not filed within
13 30 days of execution. A copy of this affidavit shall be filed
14 with the Auditor General.
15     (d) Professional and artistic services contracts. No
16 voucher shall be submitted to the Comptroller for a warrant to
17 be drawn for the payment of money from the State treasury or
18 from other funds held by the State Treasurer on account of any
19 contract for services involving professional or artistic
20 skills involving an expenditure of more than $5,000 for the
21 same type of service at the same location during any fiscal
22 year unless the contract is reduced to writing before the
23 services are performed and filed with the Comptroller. When a
24 contract for professional or artistic skills in excess of
25 $5,000 was not reduced to writing before the services were
26 performed, the Comptroller shall refuse to issue a warrant for

1 payment for the services until the State agency files with the
2 Comptroller:
3         (1) a written contract covering the services, and
4         (2) an affidavit, signed by the chief executive officer
5     of the State agency or his or her designee, stating that
6     the services for which payment is being made were agreed to
7     before commencement of the services and setting forth an
8     explanation of why the contract was not reduced to writing
9     before the services commenced.
10 A copy of this affidavit shall be filed with the Auditor
11 General. The Comptroller shall maintain professional or
12 artistic service contracts filed under this Section separately
13 from other filed contracts.
14     (e) Method of source selection. When a contract is filed
15 with the Comptroller under this Section, the Comptroller's file
16 shall identify the method of source selection used in obtaining
17 the contract.
