SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.712 new
625 ILCS 5/3-685 new

    Amends the Illinois Vehicle Code and the State Finance Act. Creates the Mesothelioma Awareness Fund. Provides for the issuance of Mesothelioma Awareness license plates. Provides that, in addition to the appropriate registration fees, an applicant for the special plate shall be charged an original issuance fee of $40 and a fee of $27 for each renewal. Provides that $25 of the additional original issuance fee and $25 of the renewal fee shall be deposited into the Mesothelioma Awareness Fund. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that, subject to appropriation by the General Assembly and approval by the Secretary of State, all moneys in the Mesothelioma Awareness Fund shall be paid to the Illinois Department of Public Health for the purpose of grants for research, education, and awareness regarding mesothelioma.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 5.712 as follows:
 
6     (30 ILCS 105/5.712 new)
7     Sec. 5.712. The Mesothelioma Awareness Fund.
 
8     Section 10. The Illinois Vehicle Code is amended by adding
9 Section 3-685 as follows:

11     Sec. 3-685. Mesothelioma Awareness license plates.
12     (a) The Secretary, upon receipt of an application made in
13 the form prescribed by the Secretary, may issue special
14 registration plates designated as Mesothelioma Awareness
15 license plates. The special plates issued under this Section
16 shall be affixed only to passenger vehicles of the first
17 division and motor vehicles of the second division weighing not
18 more than 8,000 pounds. Plates issued under this Section shall
19 expire according to the multi-year procedure established by
20 Section 3-414.1 of this Code.
21     (b) The design and color of the plates is wholly within the

1 discretion of the Secretary of State. The Secretary, in his or
2 her discretion, may allow the plates to be issued as vanity or
3 personalized plates under Section 3-405.1 of this Code. The
4 Secretary shall prescribe stickers or decals as provided under
5 Section 3-412 of this Code.
6     (c) An applicant for the special plate shall be charged a
7 $40 fee for original issuance in addition to the appropriate
8 registration fee. Of this fee, $25 shall be deposited into the
9 Mesothelioma Awareness Fund and $15 shall be deposited into the
10 Secretary of State Special License Plate Fund, to be used by
11 the Secretary to help defray the administrative processing
12 costs.
13     For each registration renewal period, a $27 fee, in
14 addition to the appropriate registration fee, shall be charged.
15 Of this fee, $25 shall be deposited into the Mesothelioma
16 Awareness Fund and $2 shall be deposited into the Secretary of
17 State Special License Plate Fund.
18     (d) The Mesothelioma Awareness Fund is created as a special
19 fund in the State treasury. All moneys in the Mesothelioma
20 Awareness Fund shall be paid, subject to appropriation by the
21 General Assembly and approval by the Secretary, to the Illinois
22 Department of Public Health for the purpose of grants for
23 research, education, and awareness regarding mesothelioma.
