HOUSE RESOLUTION

 
2     WHEREAS, The Patient Protection and Affordable Care Act was
3 signed into law on March 23, 2010 to provide for federal reform
4 of health care, including the expansion of eligibility under
5 the Medicaid program and additional regulation of the private
6 insurance industry; and
 
7     WHEREAS, Although the provisions of the Patient Protection
8 and Affordable Care Act include over 2,000 pages of amendatory
9 language, many provisions require the implementation of
10 federal administrative rules to provide addition direction to
11 states to implement the provisions; and
 
12     WHEREAS, States across the nation are taking different
13 approaches to implement the federal provisions, with some
14 states deferring action until the implementation of federal
15 rules and some states taking a more proactive role in changing
16 state laws and administrative rules; and
 
17     WHEREAS, Provisions have already been drafted in Illinois
18 to implement state level changes in regard to regulation of the
19 insurance industry, including provisions related to insurance
20 rescissions, oversight of proposed rate changes, and expansion
21 of the Comprehensive Health Insurance Plan to cover additional
22 uninsured individuals; and

1     WHEREAS, Changes to State law and rules should result from
2 full discussion among all interested stakeholders; therefore,
3 be it
 
4     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
5 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
6 the House Healthcare Reform Implementation Council is
7 established for the purpose of examining and developing
8 implementation guidelines for the provisions of the Patient
9 Protection and Affordable Care Act; and be it further
 
10     RESOLVED, That the Council shall be comprised of members as
11 follows: (1) 4 members of the House of Representatives and 4
12 members of the general public appointed by the Speaker of the
13 House of Representatives; and (2) 4 members of the House of
14 Representatives and 4 members of the general public appointed
15 by the Minority Leader of the House of Representatives; and be
16 it further
 
17     RESOLVED, That the Speaker of the House of Representatives
18 and the Minority Leader of the House of Representatives shall
19 each designate one legislative member to serve as co-chair of
20 the Council; and be it further
 
21     RESOLVED, That the Director of Healthcare and Family

1 Services, the Secretary of Human Services, the Director of
2 Public Health, and the Director of the Department of Insurance
3 shall serve as ex officio non-voting members of the Council;
4 and be it further
 
5     RESOLVED, That the Council shall serve without
6 compensation or reimbursement for expenses; the Council shall
7 meet at the call of the 2 co-chairs; the Council may conduct
8 public hearings to gather testimony from interested parties
9 regarding the implementation of the Patient Protection and
10 Affordable Care Act or other healthcare reforms; the Council
11 may advise State agencies regarding statutory or
12 administrative rule changes for the implementation of the
13 Patient Protection and Affordable Care Act or other healthcare
14 reforms; and be it further
 
15     RESOLVED, That the Council shall report to the Speaker of
16 the House and the Minority Leader of the House annually, or as
17 it deems necessary, regarding the action and recommendations of
18 the Council; and be it further
 
19     RESOLVED, That the Department of Insurance, with
20 cooperation from the Department of Healthcare and Family
21 Services shall provide staff and administrative support to the
22 Council.
