SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/17-30 new

    Amends the Criminal Code of 1961. Creates the offense of paternity fraud. Provides that a person commits the offense by knowingly alleging that a person is the biological father of a child when that person knows that the allegation is false and may result in the person alleged to be the biological father of the child being erroneously adjudicated as the father of the child. Provides that the penalty is a Class A misdemeanor.

1     AN ACT in relation to criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 17-30 as follows:
 
6     (720 ILCS 5/17-30 new)
7     Sec. 17-30. Paternity fraud.
8     (a) A person commits the offense of paternity fraud when:
9         (1) he or she knowingly alleges that a person is the
10     biological father of a child; and
11         (2) he or she knows, at the time that he or she makes
12     the allegation, that the allegation: (A) is false and (B)
13     may result in the person alleged to be the biological
14     father of a child being erroneously adjudicated as the
15     father of the child.
16     (b) Sentence. Paternity fraud is a Class A misdemeanor.
