SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game for the benefit of research pertaining to newborn screening, to commence on July 1, 2010. Provides that the net revenue from the scratch-off game shall be deposited into the Newborn Screening Research Fund for appropriation by the General Assembly to the Department of Public Health for the purpose of making grants to organizations in Illinois conducting research pertaining to newborn screening. Amends the State Finance Act to create the Newborn Screening Research Fund. Effective immediately.

1     AN ACT concerning the lottery.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by adding
5 Section 21.9 as follows:
 
6     (20 ILCS 1605/21.9 new)
7     Sec. 21.9. Newborn screening scratch-off game.
8     (a) The Department shall offer a special instant
9 scratch-off game for the benefit of research pertaining to
10 newborn screening. The game shall commence on July 1, 2010 or
11 as soon thereafter, in the discretion of the Director, as is
12 reasonably practical. The operation of the game shall be
13 governed by this Act and any rules adopted by the Department.
14 If any provision of this Section is inconsistent with any other
15 provision of this Act, then this Section governs.
16     (b) The Newborn Screening Research Fund is created as a
17 special fund in the State treasury. The net revenue from the
18 newborn screening scratch-off game created under this Section
19 shall be deposited into the Fund for appropriation by the
20 General Assembly to the Department of Public Health for the
21 purpose of making grants to organizations in Illinois that
22 conduct research pertaining to newborn screening. The grant
23 funds may not be used for institutional, organizational, or

1 community-based overhead costs, indirect costs, or levies.
2     Moneys received for the purposes of this Section,
3 including, without limitation, net revenue from the special
4 instant scratch-off game and from gifts, grants, and awards
5 from any public or private entity, must be deposited into the
6 Fund. Any interest earned on moneys in the Fund must be
7 deposited into the Fund.
8     (c) During the time that tickets are sold for the newborn
9 screening scratch-off game, the Department shall not
10 unreasonably diminish the efforts devoted to marketing any
11 other instant scratch-off lottery game.
12     (d) The Department may adopt any rules necessary to
13 implement and administer the provisions of this Section.
14     (e) For purposes of this Section:
15     "Research" includes, without limitation, expenditures to
16 develop and advance the understanding, techniques, and
17 modalities effective for preventing birth defects immediately
18 following the birth of the baby.
19     "Net revenue" means the total amount for which tickets have
20 been sold less the sum of the amount paid out in the prizes and
21 the actual administrative expenses of the Department solely
22 related to the scratch-off game under this Section.
 
23     Section 90. The State Finance Act is amended by adding
24 Section 5.755 as follows:
