AMENDMENT TO HOUSE BILL 5243

2     AMENDMENT NO. ______. Amend House Bill 5243 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Children's Health Insurance Program Act is
5 amended by adding Section 26 as follows:
 
6     (215 ILCS 106/26 new)
7     Sec. 26. Moratorium on eligibility. Beginning on the
8 effective date of this amendatory Act of the 96th General
9 Assembly, there shall be a 2-year moratorium on the expansion
10 of eligibility under the Program through increasing financial
11 eligibility standards beyond those in place February 1, 2010.
12 Eligibility may be expanded only if authorized by a 3/5 vote in
13 both the House and Senate. This moratorium shall not apply to
14 expansions required by federal law.
 
15     Section 10. The Covering ALL KIDS Health Insurance Act is

1 amended by adding Section 36 as follows:
 
2     (215 ILCS 170/36 new)
3     Sec. 36. Moratorium on eligibility. Beginning on the
4 effective date of this amendatory Act of the 96th General
5 Assembly, there shall be a 2-year moratorium on the expansion
6 of eligibility under the Program through increasing financial
7 eligibility standards beyond those in place February 1, 2010.
8 Eligibility may be expanded only if authorized by a 3/5 vote in
9 both the House and Senate. This moratorium shall not apply to
10 expansions required by federal law.
 
11     Section 15. The Illinois Public Aid Code is amended by
12 adding Section 5-1.3 as follows:
 
13     (305 ILCS 5/5-1.3 new)
14     Sec. 5-1.3. Moratorium on eligibility and program
15 expansions. Beginning on the effective date of this amendatory
16 Act of the 96th General Assembly, there shall be a 2-year
17 moratorium on the expansion of eligibility through increasing
18 financial eligibility standards or the creation of new programs
19 which would add new categories of eligible individuals under
20 the medical assistance program under this Article in addition
21 to those categories covered on February 1, 2010. Eligibility
22 may be expanded only if authorized by a 3/5 vote in both the
23 House and Senate. This moratorium shall not apply to expansions

2     Section 99. Effective date. This Act takes effect upon
3 becoming law.".
