SYNOPSIS AS INTRODUCED:
 
210 ILCS 45/3-808 new
405 ILCS 5/6-104.5 new

    Amends the Nursing Home Care Act and the Mental Health and Developmental Disabilities Code. Provides that beginning on the effective date of this amendatory Act, there shall be a 2-year moratorium on the enforcement of any new State mandate which would affect facilities or community providers unless such mandate is fully funded through a State appropriation. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by adding
5 Section 3-808 as follows:
 
6     (210 ILCS 45/3-808 new)
7     Sec. 3-808. Moratorium on State mandate. Beginning on the
8 effective date of this amendatory Act of the 96th General
9 Assembly, there shall be a 2-year moratorium on the enforcement
10 of any new State mandate which would affect facilities or
11 community providers unless such mandate is fully funded through
12 a State appropriation.
 
13     Section 10. The Mental Health and Developmental
14 Disabilities Code is amended by adding Section 6-104.5 as
15 follows:
 
16     (405 ILCS 5/6-104.5 new)
17     Sec. 6-104.5. Moratorium on State mandate. Beginning on the
18 effective date of this amendatory Act of the 96th General
19 Assembly, there shall be a 2-year moratorium on the enforcement
20 of any new State mandate which would affect facilities or
21 community providers unless such mandate is fully funded through

2     Section 99. Effective date. This Act takes effect upon
3 becoming law.
