SYNOPSIS AS INTRODUCED:

    Amends the State Finance Act. Creates the "I Want to Pay More" Fund. Provides that, on the first day of each month, the State Treasurer and the State Comptroller shall transfer all moneys remaining in the "I Want to Pay More" Fund to the General Revenue Fund. Provides that the Department of Revenue shall oversee the Fund. Amends the Illinois Income Tax Act. Creates an income tax checkoff for voluntary contributions to the "I Want to Pay More" Fund. Effective immediately.

1     AN ACT concerning revenue.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Revenue Law of the Civil
5 Administrative Code of Illinois is amended by adding Section
6 2505-755 as follows:
 
7     (20 ILCS 2505/2505-755 new)
8     Sec. 2505-755. The "I Want to Pay More" Fund; oversight.
9 The Department shall oversee the "I Want to Pay More" Fund. On
10 or before January 31 of each year, the Department shall report
11 to the Governor and the General Assembly the amount of money
12 that has been received by the Fund during the previous calendar
13 year. The Department shall also develop, by administrative
14 rule, a program to inform the public about the existence of the
15 "I Want to Pay More" Fund.
 
16     Section 10. The State Finance Act is amended by adding
17 Sections 5.721 and 6z-76 as follows:

1     Sec. 6z-76. "I Want to Pay More" Fund; creation. The "I
2 Want to Pay More" Fund is created as a special fund in the
3 State treasury. The Fund may receive moneys from gifts, grants,
4 contributions, and other sources. On the first day of each
5 month, the State Treasurer and the State Comptroller shall
6 transfer all moneys remaining in the "I Want to Pay More" Fund
7 to the General Revenue Fund.
 
8     Section 15. The Illinois Income Tax Act is amended by
9 adding Section 507SS as follows:

11     Sec. 507SS. The "I Want to Pay More" checkoff. For taxable
12 years ending on or after December 31, 2009, the Department
13 shall print, on its standard individual income tax form, a
14 provision indicating that, if the taxpayer wishes to make an
15 additional voluntary contribution to the "I Want to Pay More"
16 Fund, then he or she may do so by stating the amount of the
17 contribution (not less than $1) on the return and indicating
18 that the contribution will reduce the taxpayer's refund or
19 increase the amount of payment to accompany the return. The
20 taxpayer's failure to remit any amount of the increased payment
21 reduces the contribution accordingly.
 
22     Section 99. Effective date. This Act takes effect upon
23 becoming law.
