AMENDMENT TO HOUSE BILL 4196

2     AMENDMENT NO. ______. Amend House Bill 4196 as follows:
3 by replacing the title with the following:
4     "AN ACT concerning State government."; and
 
5 by replacing everything after the enacting clause with the
6 following:
 
7     "Section 5. The Military Code of Illinois is amended by
8 changing Section 30.25 as follows:
 
9     (20 ILCS 1805/30.25)
10     Sec. 30.25. Stay of prosecution. During and for a period of
11 14 days after a period of training or duty in excess of 29 days
12 either under Title 32 of the United States Code or under State
13 Active Duty, a court having jurisdiction over the enforcement
14 of any civil obligation or liability, the prosecution of any
15 civil suit or proceeding, or the entry or enforcement of any

1 civil order, writ, judgment, or decree shall may stay,
2 postpone, or suspend the matter if the court determines that a
3 person's failure to meet the obligation is the direct result of
4 that period of training or duty. The stay, postponement, or
5 suspension of proceedings does not in any way modify any
6 condition, obligation, term, or liability agreed upon or
7 incurred by a person in military service including but not
8 limited to accrued interest, late fees, or penalties. No stay,
9 postponement, or suspension shall be provided regarding any
10 written agreement entered into, or debt that is incurred, by
11 the person during or after his or her period of training or
12 duty either under Title 32 of the United States Code or under
13 State Active Duty.
