SYNOPSIS AS INTRODUCED:
 
20 ILCS 2605/2605-580

    Amends the Department of State Police Law of the Civil Administrative Code of Illinois. In a Section concerning the creation and operation of a Cyber Gang Unit (instead of Internet Gang Crime Units), allocates moneys to the Lake County Metropolitan Enforcement Group (instead of to the Cook County Sheriff's Office, the City of Danville Police Department, and the Village of Round Lake Heights Police Department). Provides that the Cyber Gang Unit Pilot Program terminates on July 1, 2012 (instead of 2010). Imposes conditions on any rulemaking authority. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-580 as follows:
 
7     (20 ILCS 2605/2605-580)
8     Sec. 2605-580. Pilot program; Cyber Gang Unit Internet Gang
9 Crime Units.
10     (a) The Department of State Police shall establish a pilot
11 program from all moneys available under which a Cyber Gang Unit
12 Internet Gang Crime Units shall be created in the Lake County
13 Metropolitan Enforcement Group. Cook County Sheriff's Office,
14 the City of Danville Police Department, and the Village of
15 Round Lake Heights Police Department. Under the pilot program
16 for the operation of Internet Gang Crime Units, 40% shall be
17 allocated to the Cook County Sheriff's Office, 30% shall be
18 allocated to the City of Danville Police Department, and 30%
19 shall be allocated to the Village of Round Lake Heights Police
20 Department.
21     (b) Under the pilot program, the Cyber Gang Unit Internet
22 Gang Crime Units shall investigate criminal activities of
23 organized gangs that involve the use of the Internet. For the

1 duration of the pilot program and in accordance with protocols
2 for inter-jurisdictional cooperation established by the
3 Department of State Police, peace officers in the Cyber Gang
4 each Internet Gang Crime Unit shall, notwithstanding any other
5 provision of law, have extra-jurisdictional authority to
6 conduct investigations and make arrests anywhere in the State
7 of Illinois regarding criminal activities of organized gangs
8 that involve the use of the Internet.
9     (c) Notwithstanding any other provision of law, if any
10 criminal statute of this State authorizes the distribution of
11 all or a portion of the proceeds realized from property seized
12 or forfeited under that statute to participating law
13 enforcement agencies or the delivery of property forfeited and
14 seized under that statute to participating law enforcement
15 agencies, a law enforcement agency in which a Cyber Gang an
16 Internet Gang Crime Unit has been created is eligible to
17 receive such a distribution or delivery if that law enforcement
18 agency participated through its Internet Gang Crime Unit,
19 regardless of the jurisdiction in which the seizure or
20 forfeiture occurs.
21     (d) The Lake County Metropolitan Enforcement Group Cook
22 County Sheriff's Office, the City of Danville Police
23 Department, and the Village of Round Lake Heights Police
24 Department shall report to the Department of State Police on a
25 quarterly basis on the activities of the Cyber Gang Unit their
26 Internet Gang Crime Units in accordance with reporting

1 guidelines established by the Department of State Police. The
2 Department of State Police shall file a consolidated report on
3 a quarterly basis with the General Assembly and the Governor.
4 The Department's consolidated report may also contain any
5 evaluations or recommendations that the Department deems
6 appropriate.
7     (e) The pilot program shall terminate on July 1, 2012 2010.
8     (f) As used in this Section, "organized gang" has the
9 meaning ascribed to it in Section 10 of the Illinois Streetgang
10 Terrorism Omnibus Prevention Act.
11     (g) Rulemaking authority to implement this amendatory Act
12 of the 96th General Assembly, if any, is conditioned on the
13 rules being adopted in accordance with all provisions of the
14 Illinois Administrative Procedure Act and all rules and
15 procedures of the Joint Committee on Administrative Rules; any
16 purported rule not so adopted, for whatever reason, is
17 unauthorized.

19     Section 99. Effective date. This Act takes effect upon
20 becoming law.
