AMENDMENT TO HOUSE BILL 3397

2     AMENDMENT NO. ______. Amend House Bill 3397 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Sex Offender Registration Act is amended by
5 adding Section 5-15 as follows:
 
6     (730 ILCS 150/5-15 new)
7     Sec. 5-15. Certain sex offenders prohibited from
8 participating in holiday events involving children under 18
9 years of age. The Department of State Police shall require that
10 a person during the period that he or she is required to be
11 registered as a sex offender under this Act if convicted of or
12 placed on supervision for a sex offense as defined in
13 subsection (a-5) of Section 3-1-2 of the Unified Code of
14 Corrections, unless the offender is a parent or guardian of the
15 person under 18 years of age present in the home and no
16 non-familial minors are present, not participate in a holiday

1 event involving children under 18 years of age, such as
2 distributing candy or other items to children on Halloween,
3 wearing a Santa Claus costume on or preceding Christmas, being
4 employed as a department store Santa Claus, or wearing an
5 Easter Bunny costume on or preceding Easter. The Department of
6 State Police shall require such sex offender to sign a
7 statement that he or she understands this requirement and that
8 failure to comply shall be considered non-compliance and
9 subject to the penalties provided in Section 10 of this Act.".
