1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by changing
5 Section 16-101 as follows:
 
6     (220 ILCS 5/16-101)
7     Sec. 16-101. Short title and applicability.
8     (a) This Article may be cited as the the Electric Service
9 Customer Choice and Rate Relief Law of 1997 and shall apply to
10 electric utilities and alternative retail electric suppliers
11 as defined in this Article. Except to the extent modified or
12 supplemented by the provisions of this Article, or where the
13 context clearly renders such provisions inapplicable, the
14 other Articles of the Public Utilities Act pertaining to public
15 utilities, public utility rates and services and the regulation
16 thereof, are fully and equally applicable to the tariffed
17 services electric utilities provide.
18     (b) The provisions of subsections (a) through (h) of
19 Section 16-111 of this Act shall not be applicable to any
20 electric utility which elects to file biennial rate proceedings
21 before the Commission in the years 1998, 2000 and 2002. An
22 electric utility electing this option shall do so by filing a
23 notice of such election with the Commission within 60 days

1 after the effective date of this amendatory Act of 1997, or its
2 right to make such election shall be irrevocably waived. An
3 electric utility electing the option specified in this
4 paragraph shall file its rate proceeding with the Commission no
5 later than August 1 of the years 1998, 2000, and 2002. The
6 electric utility's filing shall comply with all requirements of
7 83 Illinois Administrative Code Parts 255 and 285 as though the
8 electric utility were filing for an increase in its rates,
9 without regard to whether such filing would produce an
10 increase, a decrease or no change in the electric utility's
11 rates and the Commission shall review the electric utility's
12 filing and shall issue its order in accordance with the
13 provisions of Section 9-201 of this Act.
