    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois and the Illinois Public Aid Code. Makes technical changes in Sections concerning criminal history record information and investigation of child care providers.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 2310-185 as follows:
 
7     (20 ILCS 2310/2310-185)  (was 20 ILCS 2310/55.51)
8     Sec. 2310-185. Criminal history record information.
9 Whenever the the Department is authorized or required by law to
10 consider some aspect of criminal history record information for
11 the purpose of carrying out its statutory powers and
12 responsibilities, then, upon request and payment of fees in
13 conformance with the requirements of Section 2605-400 of the
14 Department of State Police Law (20 ILCS 2605/2605-400), the
15 Department of State Police is authorized to furnish, pursuant
16 to positive identification, the information contained in State
17 files that is necessary to fulfill the request.

19     Section 10. The Illinois Public Aid Code is amended by
20 changing Section 9A-11.5 as follows:

1     Sec. 9A-11.5. Investigate child care providers. Any child
2 care provider receiving funds from the the child care
3 assistance program under this Code who is not required to be
4 licensed under the Child Care Act of 1969 shall, as a condition
5 of eligibility to participate in the child care assistance
6 program under this Code, authorize in writing on a form
7 prescribed by the Department of Children and Family Services,
8 periodic investigations of the Central Register, as defined in
9 the Abused and Neglected Child Reporting Act, to ascertain if
10 the child care provider has been determined to be a perpetrator
11 in an indicated report of child abuse or neglect.
12     The Department of Children and Family Services shall
13 conduct an investigation of the Central Register at the request
14 of the Department. The Department shall request the Department
15 of Children and Family Services to conduct periodic
16 investigations of the Central Register. The Department shall by
17 rule determine when payment to an unlicensed child care
18 provider may be withheld if there is an indicated finding
19 against the provider in the Central Register.
