AMENDMENT TO HOUSE BILL 1753

2     AMENDMENT NO. ______. Amend House Bill 1753 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Heating, Ventilation, Air Conditioning, and Refrigeration
6 Contractor Registration Act.
 
7     Section 5. Objects and Purpose. The installation and
8 maintenance of heating, ventilation, air conditioning, and
9 refrigeration ("HVACR") systems in the State is hereby declared
10 to affect the public health, safety, and welfare and to be
11 subject to regulation and control in the public interest. It is
12 further declared to be a matter of public interest and concern
13 that the installation and maintenance of HVACR systems as
14 defined in this Act merit and receive the confidence of the
15 public, and that only qualified persons are authorized to
16 install and maintain HVACR systems in the State. The purpose of

1 this Act is to provide for the registration of persons who
2 install and repair HVACR systems in the State and this Act
3 shall be liberally construed to best carry out these subjects
4 and purposes.
 
5     Section 10. Powers and duties of the Secretary. The
6 Secretary of Financial and Professional Regulation shall by
7 rule:
8     (1) Prepare and issue registered HVACR contractor
9 certificates as provided in this Act. The requirements for
10 issuance of a registration certificate shall include, but are
11 not limited to, documentation stating the following criteria
12 have been satisfied:
13         (A) the required application fee has been paid;
14         (B) the applicant is at least 18 years of age;
15         (C) the applicant has submitted a certificate of
16     insurance showing liability coverage of at least $250,000
17     and Workman's Compensation coverage of at least one
18     technician in the HVACR classifications of #5190, #5537,
19     and #9014, as established by the National Council on
20     Compensation Insurance ("NCCI"), and vehicle insurance, if
21     applicable; and
22         (D) the applicant has signed an attestation of honest
23     representation of all of the above.
24     (2) Renew the registration of any applicant who has
25 fulfilled the requirements and who has paid the required

1 renewal fee.
2     (3) Prescribe rules for hearings to deny, suspend, revoke,
3 or reinstate registrations as provided in this Act.
 
4     Section 15. The Regulatory Sunset Act is amended by adding
5 Section 4.30 as follows:
 
6     (5 ILCS 80/4.30 new)
7     Sec. 4.30. Act repealed on January 1, 2020. The following
8 Act is repealed on January 1, 2020:
9     The Heating, Ventilation, Air Conditioning, and
10 Refrigeration Contractor Registration Act.
 
11     Section 999. Effective date. This Act takes effect upon
12 becoming law.".
