AMENDMENT TO HOUSE BILL 1721

2    AMENDMENT NO. ______. Amend House Bill 1721 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Hospital Licensing Act is amended by adding
5Section 4.7 as follows:
 
6    (210 ILCS 85/4.7 new)
7    Sec. 4.7. Additional licensing requirements.
8    (a) A hospital located in a county with fewer than 325,000
9inhabitants may apply to the Department for approval to conduct
10its operations from more than one location within the county
11under a single license at a separate building or facility
12already licensed as a hospital. The host hospital shall house
13the licensee. The licensee's application shall be supported by
14information that its operations at the host hospital will
15provide access to necessary services for the region that the
16host hospital does not provide. The services proposed by the

1licensee at the host hospital shall not consist of emergency
2services.
3    (b) The portion of the facilities or buildings operated by
4the licensee at the host hospital shall be leased in part and
5operated by a single corporation or other legal entity serving
6as the licensee and shall have a single:
7        (1) board of directors with the responsibility for
8    governance, including financial oversight and authority to
9    designate or remove the chief executive officer;
10        (2) medical staff accountable to the board of directors
11    of the licensee and governed by a single set of medical
12    staff bylaws and associated rules and regulation of the
13    licensee, with responsibility for the quality of the
14    medical services provided by the licensee at the host
15    hospital side; and
16        (3) chief executive officer, accountable to the board
17    of directors of the licensee, with management
18    responsibility for the licensee's operations at the host
19    hospital site.
20    The host hospital and licensee shall be jointly responsible
21for hospital licensing requirements relating to design and
22construction, engineering and maintenance of the physical
23plan, waste disposal, and fire safety.
24    (c) The licensee and host hospital shall notify the public
25and patients through general signage and written notification
26provided upon admission that services are provided at the host

1hospital site by 2 separately licensed hospitals. The signage
2shall specify which services are provided by the host hospital
3or the licensee or both.
4    (d) One emergency department shall serve the host hospital.
5Patients shall be notified that emergency services are provided
6by the host hospital. Those patients that require admission
7from the emergency department to a service that is operated by
8the licensee shall be admitted according to the Emergency
9Medical Treatment and Active Labor Act regulations and
10transferred to the licensee. The admission, registration, and
11consent form documents shall be specific to the licensee.
12    (e) The licensee and host hospital shall submit to the
13Department a comprehensive plan describing the services and
14operations of each facility or building and between the
15licensee and host hospital, and how common services or
16operations will be coordinated between the various locations.
17Nothing in this Section relieves a hospital from the
18requirements in the Illinois Health Facilities Planning Act.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
