AMENDMENT TO HOUSE BILL 1512

2    AMENDMENT NO. ______. Amend House Bill 1512 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by changing
5Sections 8.46 and 8.49 as follows:
 
6    (30 ILCS 105/8.46)
7    Sec. 8.46. Transfers to the FY09 Budget Relief Fund.
8    (a) The FY09 Budget Relief Fund is created as a special
9fund in the State Treasury. Amounts may be expended from the
10Fund only pursuant to specific authorization by appropriation.
11    (b) Notwithstanding any other State law to the contrary,
12the State Treasurer and State Comptroller are directed to
13transfer to the FY09 Budget Relief Fund the following amounts
14from the funds specified, in equal quarterly installments with
15the first made on the effective date of this amendatory Act of
16the 95th General Assembly, or as soon thereafter as practical,

15    (c) On and after the effective date of this amendatory Act
16of the 95th General Assembly through June 30, 2009, when any of
17the funds listed in subsection (b) have insufficient cash from
18which the State Comptroller may make expenditures properly
19supported by appropriations from the fund, then the State
20Treasurer and State Comptroller shall transfer from the FY09
21Budget Relief Fund to the fund only such amount as is
22immediately necessary to satisfy outstanding expenditure
23obligations on a timely basis, subject to the provisions of the
24State Prompt Payment Act. All or a portion of the amounts
25transferred from the FY09 Budget Relief Fund to a fund pursuant
26to this subsection (c) from time to time may be re-transferred

1by the State Comptroller and the State Treasurer from the
2receiving fund into the FY09 Budget Relief Fund as soon as and
3to the extent that deposits are made into or receipts are
4collected by the receiving fund.
5    (d) In addition to any other transfers that may be provided
6for by law, on December 1, 2010, or as soon thereafter as may
7be practical, the State Comptroller shall direct and the State
8Treasurer shall transfer the sum of $500,000 from the FY09
9Budget Relief Fund to the DHS Private Resources Fund.

24All of these transfers shall be made in equal quarterly
25installments with the first made on July 1, 2009, or as soon
26thereafter as practical, and with the remaining transfers to be

1made on October 1, January 1, and April 1, or as soon
2thereafter as practical. These transfers shall be made
3notwithstanding any other provision of State law to the
4contrary.
5    (b) On and after the effective date of this amendatory Act
6of the 96th General Assembly through June 30, 2010, when any of
7the funds listed in subsection (a) have insufficient cash from
8which the State Comptroller may make expenditures properly
9supported by appropriations from the fund, then the State
10Treasurer and State Comptroller shall transfer from the General
11Revenue Fund to the fund such amount as is immediately
12necessary to satisfy outstanding expenditure obligations on a
13timely basis, subject to the provisions of the State Prompt
14Payment Act.
15    (c) If the Director of the Governor's Office of Management
16and Budget determines that any transfer to the General Revenue
17Fund from a special fund under subsection (a) either (i)
18jeopardizes federal funding based on a written communication
19from a federal official or (ii) violates an order of a court of
20competent jurisdiction, then the Director may order the State
21Treasurer and State Comptroller, in writing, to transfer from
22the General Revenue Fund to that listed special fund all or
23part of the amounts transferred from that special fund under
24subsection (a).
25    (d) In addition to any other transfers that may be provided
26for by law, on December 1, 2010, or as soon thereafter as may

1be practical, the State Comptroller shall direct and the State
2Treasurer shall transfer the following amounts from the General
3Revenue Fund to the designated funds:
4    Hansen-Therkelsen Memorial Deaf Student

6    DHS Private Resources Fund.....................$1,000,000

9    Section 99. Effective date. This Act takes effect upon
