    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game to support State parks and State historic sites, to commence on July 1, 2009 and to be discontinued on December 31, 2014. Provides that the net revenue from the game shall be deposited into the State Parks and Historic Sites Endowment Fund for appropriation by the General Assembly to the Department of Natural Resources for the purpose of funding State parks and to the Historic Preservation Agency for the purpose of funding State historic sites. Amends the State Finance Act to create the State Parks and Historic Sites Endowment Fund. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Sections 2 and 20 and by adding Section 21.9 as follows:
 
6     (20 ILCS 1605/2)  (from Ch. 120, par. 1152)
7     Sec. 2. This Act is enacted to implement and establish
8 within the State a lottery to be operated by the State, the
9 entire net proceeds of which are to be used for the support of
10 the State's Common School Fund, except as provided in Sections
11 21.2, 21.5, 21.6, 21.7, and 21.8, and 21.9.

16     Sec. 20. State Lottery Fund.
17     (a) There is created in the State Treasury a special fund
18 to be known as the "State Lottery Fund". Such fund shall
19 consist of all revenues received from (1) the sale of lottery
20 tickets or shares, (net of commissions, fees representing those
21 expenses that are directly proportionate to the sale of tickets
22 or shares at the agent location, and prizes of less than $600

1 which have been validly paid at the agent level), (2)
2 application fees, and (3) all other sources including moneys
3 credited or transferred thereto from any other fund or source
4 pursuant to law. Interest earnings of the State Lottery Fund
5 shall be credited to the Common School Fund.
6     (b) The receipt and distribution of moneys under Section
7 21.5 of this Act shall be in accordance with Section 21.5.
8     (c) The receipt and distribution of moneys under Section
9 21.6 of this Act shall be in accordance with Section 21.6.
10     (d) The receipt and distribution of moneys under Section
11 21.7 of this Act shall be in accordance with Section 21.7.
12     (e) The receipt and distribution of moneys under Section
13 21.8 of this Act shall be in accordance with Section 21.8.
14     (f) The receipt and distribution of moneys under Section
15 21.9 of this Act shall be in accordance with Section 21.9.

20     Sec. 21.9. State parks and historic sites scratch-off game.
21     (a) The Department shall offer a special instant
22 scratch-off game to support State parks and State historic
23 sites. The game shall commence on July 1, 2009 or as soon
24 thereafter, in the discretion of the Director, as is reasonably
25 practical, and shall be discontinued on December 31, 2014. The

1 operation of the game is governed by this Act and by any rules
2 adopted by the Department. If any provision of this Section is
3 inconsistent with any other provision of this Act, then this
4 Section governs.
5     (b) The State Parks and Historic Sites Endowment Fund is
6 created as a special fund in the State treasury. The net
7 revenue from the State parks and historic sites special instant
8 scratch-off game must be deposited into the Fund for
9 appropriation by the General Assembly to the Department of
10 Natural Resources for the purpose of funding State parks and to
11 the Historic Preservation Agency for the purpose of funding
12 State historic sites.
13     Moneys received for the purposes of this Section,
14 including, without limitation, net revenue from the special
15 instant scratch-off game and gifts, grants, and awards from any
16 public or private entity, must be deposited into the Fund. Any
17 interest earned on moneys in the Fund must be deposited into
18 the Fund.
19     For purposes of this subsection, "net revenue" means the
20 total amount for which tickets have been sold less the sum of
21 the amount paid out in prizes and the actual administrative
22 expenses of the Department solely related to the State parks
23 and historic sites game.
24     (c) During the time that tickets are sold for the State
25 parks and historic sites game, the Department shall not
26 unreasonably diminish the efforts devoted to marketing any

1 other instant scratch-off lottery game.
2     (d) The Department may adopt any rules necessary to
3 implement and administer the provisions of this Section.
 
4     Section 10. The State Finance Act is amended by adding
5 Section 5.719 as follows:
 
6     (30 ILCS 105/5.719 new)
7     Sec. 5.719. The State Parks and Historic Sites Endowment
8 Fund.
 
9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
