SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/3-143.5 new
40 ILCS 5/4-134.5 new
30 ILCS 805/8.33 new

    Amends the Downstate Police and Downstate Firefighter Articles of the Illinois Pension Code. Provides that, in addition to any duty under the Open Meetings Act, the board shall provide written notice of each meeting, as defined in the Open Meetings Act, to the mayor or village or town president at least 48 hours prior to that meeting. Requires the notice to set forth the time, date, location, and agenda of the meeting. Provides that, if the board fails to provide the notice required under this Section for any meeting, then any action taken at that meeting is invalid. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by adding
5 Sections 3-143.5 and 4-134.5 as follows:
 
6     (40 ILCS 5/3-143.5 new)
7     Sec. 3-143.5. Notice of meetings. In addition to any duty
8 under the Open Meetings Act, the board shall provide written
9 notice of each meeting, as defined in the Open Meetings Act, to
10 the mayor or village or town president at least 48 hours prior
11 to that meeting. The notice must set forth the time, date,
12 location, and agenda of the meeting. If the board fails to
13 provide the notice required under this Section for any meeting,
14 then any action taken at that meeting is invalid.

16     Sec. 4-134.5. Notice of meetings. In addition to any duty
17 under the Open Meetings Act, the board shall provide written

2     Section 90. The State Mandates Act is amended by adding
3 Section 8.33 as follows:
 
4     (30 ILCS 805/8.33 new)
5     Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
6 of this Act, no reimbursement by the State is required for the
7 implementation of any mandate created by this amendatory Act of
8 the 96th General Assembly.
 
9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
