1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Disabilities Services Act of 2003 is amended
5 by adding the heading of Article IV and Section 60 as follows:

ARTICLE IV. RAPID REINTEGRATION PILOT PROGRAM

9     Sec. 60. Rapid Reintegration Pilot Program.
10     (a) The Department of Human Services shall operate a Rapid
11 Reintegration Pilot Program. The purpose of the pilot program
12 is to demonstrate that, with appropriate support and services,
13 individuals with physical disabilities and individuals with
14 mental illness who need a short-term placement of 6 months or
15 less in a nursing facility can successfully return to the
16 community without experiencing unnecessary
17 institutionalization. The initial pilot program sites shall be
18 those initiated or operated by the Department in Fiscal Year
19 2009. The pilot program may be expanded to other sites as
20 funding becomes available for that purpose.
21     (b) The Department of Human Services shall secure the
22 cooperation of hospitals in the geographic areas served by the

1 pilot program so that hospitals will coordinate with the
2 Service Coordination Agencies and the Home Services Program to
3 verify whether the individual is expected to have a short-term
4 stay of 6 months or less in a nursing facility upon discharge
5 from the hospital.
6     (c) The Service Coordination Agencies and the Home Services
7 Program in the pilot areas shall make an initial assessment and
8 a post-admission assessment to ascertain whether an individual
9 needs a nursing facility level of care and whether the
10 individual is expected to be in the nursing facility for a
11 short-term stay of 6 months or less.
12     (d) The Service Coordination Agencies and the Home Services
13 Program shall make necessary and appropriate efforts to
14 reintegrate any individual who is found to need nursing
15 facility level of care and is expected to be in a nursing home
16 for a short-term stay of 6 months or less, including
17 collaboration with local service providers, such as centers for
18 independent living and community mental health agencies.
19     (e) If an individual who, through the pilot program, has
20 been identified as needing a short-term stay of 6 months or
21 less is admitted to a nursing facility, the individual shall be
22 assessed for eligibility for an enhanced Community Home
23 Maintenance Allowance to allow the individual to retain income
24 for a period of up to 6 months in order to retain his or her
25 home.
26     (f) The pilot program shall operate for not less than 3

1 years after the effective date of this amendatory Act of the
2 96th General Assembly. The Department of Human Services shall
3 assess the effectiveness of the pilot program in preventing the
4 unnecessary institutionalization of individuals with physical
5 disabilities or mental illness and allowing them to
6 successfully return to their pre-admission living
7 arrangements.
8     (g) The pilot program established under this Article shall
9 not apply to facilities that qualify under federal law as
10 institutions for mental disease.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
