SYNOPSIS AS INTRODUCED:

410 ILCS 620/3.23 new
410 ILCS 620/4   from Ch. 56 1/2, par. 504

    Amends the Illinois Food, Drug and Cosmetic Act. Prohibits the sale, offering for sale, or delivery of an energy drink containing stimulants, including, but not limited to, caffeine, taurine, or guarana to a person under 18 years of age. Provides that the Director of the Department of Public Health is authorized to file a complaint and seek a temporary restraining order or preliminary or permanent injunction restraining the sale, offering for sale, or delivery of an energy drink to a person under 18 years of age.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Food, Drug and Cosmetic Act is
5 amended by changing Sections 3 and 4 and by adding Section 3.23
6 as follows:

8     Sec. 3. The enumerated acts in Sections 3.1 through 3.23
9 3.21 and the causing thereof are prohibited in this State.

12     Sec. 3.23. The sale, offering for sale, or delivery of an
13 energy drink containing stimulants, including, but not limited
14 to, caffeine, taurine, or guarana to a person under 18 years of
15 age.

17     Sec. 4. In addition to the remedies hereinafter provided
18 the Director is authorized to file a complaint and apply to the
19 circuit court for, and such court may upon hearing and for
20 cause shown grant, a temporary restraining order or preliminary
21 or permanent injunction restraining any person from violating
