SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/57.6a new

    Amends the Environmental Protection Act. Provides that, at least twice per calendar year, and more frequently if determined necessary by the Environmental Protection Agency, the operator of a filling station or motor-vehicle repair shop must wash or cleanse all vehicular-use areas of the facility to remove any and all residue, stains, or other matter remaining from oil spills and other spilled materials. Requires the operator to provide a positive mechanism to prevent the wash water or waste water from leaving the facility or discharging into any sewer system. Requires the operator to maintain records concerning the washing. Effective immediately.

1     AN ACT concerning environmental safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Environmental Protection Act is amended by
5 adding Section 57.6a as follows:
 
6     (415 ILCS 5/57.6a new)
7     Sec. 57.6a. Semiannual surficial cleansing.
8     (a) At least twice per calendar year, and more frequently
9 if determined necessary by the Agency, the operator of a
10 facility must wash or cleanse all vehicular-use areas of the
11 facility to remove any and all residue, stains, or other matter
12 remaining from oil spills and other spilled materials.
13     (b) Permitted methods of cleansing under this Section
14 include power washing or equivalent wet washing or dry cleaning
15 methods. If power washing or another wet-washing method is
16 used, then the operator of a facility must provide a positive
17 mechanism to prevent the wash water or waste water from leaving
18 the facility or discharging into any sewer system. In addition,
19 the operator shall manage and dispose of all waste and effluent
20 in a manner consistent with federal and State law.
21     (c) The operator shall keep records of dates on which
22 vehicular-use area cleaning is performed and records of waste
23 disposal onsite for 3 years and make those records available

1 for inspection upon request by the Agency.
2     (d) For the purposes of this Section:
3     "Facility" means a filling station or motor-vehicle repair
4 shop.
5     "Vehicular-use area" means any part of the facility, except
6 for any enclosed or partially enclosed structure, that is
7 devoted to use by or for motor vehicles, including parking
8 areas, storage areas for motor vehicles, loading areas, service
9 areas and drives, and access drives and drive ways.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.
