SYNOPSIS AS INTRODUCED:
 
30 ILCS 500/25-15

    Amends the Illinois Procurement Code. Authorizes the Department of Central Management Services to establish various indefinite quantity, indefinite delivery master contracts for supplies and services awarded to multiple vendors. When the supplies or services are needed, requires the Department, or the State agency needing the supplies or services, to enter into competitive negotiations with at least 3 qualified contracted vendors.

1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Procurement Code is amended by
5 changing Section 25-15 as follows:
 
6     (30 ILCS 500/25-15)
7     Sec. 25-15. Method of source selection.
8     (a) Competitive sealed bidding. Except as provided in
9 subsection (b) and Sections 20-20, 20-25, and 20-30, all State
10 contracts for supplies and services shall be awarded by
11 competitive sealed bidding in accordance with Section 20-10.
12     (b) Other methods.
13         (1) Multiple award. The Department of Central
14     Management Services may establish various indefinite
15     quantity, indefinite delivery master contracts for
16     supplies and services with award to multiple vendors for
17     the same supply or service. These master contracts shall be
18     established through a competitive process designed to
19     ensure vendors are qualified to provide the supply or
20     service, are responsible, agree to State contracting
21     requirements, and have competitive pricing.
22         When there is a need for the supply or service, the
23     Department shall enter into competitive negotiations with

1     at least 3 qualified contracted vendors to obtain the
2     needed supply or service. The Department may authorize the
3     State agency needing the supply or service to conduct the
4     negotiations. The Department shall publish in the Illinois
5     Procurement Bulletin a notice of award at least 2 weeks
6     prior to signing the contract, and if the low cost vendor
7     is not selected the notice must detail the reasons why the
8     higher cost vendor was selected. The Department may
9     promulgate rules further defining this procurement
10     technique.
11          (2) Competitive alternatives. The chief procurement
12     officer may establish by rule (i) categories of purchases,
13     including non-governmental joint purchases, that may be
14     made without competitive sealed bidding and (ii) the most
15     competitive alternate method of source selection that
16     shall be used for each category of purchase.
