| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Counties Code is amended by changing Section |
| 5 |
| 3-5031 as follows:
|

| Sec. 3-5031. Penalty. If any recorder shall willfully fail |
| 8 |
| to perform
any duty imposed upon him by this Division, he shall |
| 9 |
| be guilty
of malfeasance in office, and shall be punished |
| 10 |
| accordingly, and shall be
liable to the party injured for all |
| 11 |
| damages occasioned thereby.
