AMENDMENT TO SENATE BILL 1857

2     AMENDMENT NO. ______. Amend Senate Bill 1857 on page 4,
3 immediately below line 9, by inserting the following:
 
4     "Section 7. The State Revenue Sharing Act is amended by
5 changing Section 2 as follows:
 
6     (30 ILCS 115/2)  (from Ch. 85, par. 612)
7     Sec. 2. Allocation and Disbursement. As soon as may be
8 after the first day of each month, the Department of Revenue
9 shall allocate among the several municipalities and counties of
10 this State the amount available in the Local Government
11 Distributive Fund and in the Income Tax Surcharge Local
12 Government Distributive Fund, determined as provided in
13 Sections 1 and 1a above. Except as provided in Sections 13 and
14 13.1 of this Act, the Department shall then certify such
15 allocations to the State Comptroller, who shall pay over to the
16 several municipalities and counties the respective amounts

1 allocated to them. The amount of such Funds allocable to each
2 such municipality and county shall be in proportion to the
3 number of individual residents of such municipality or county
4 to the total population of the State, determined in each case
5 on the basis of the latest census of the State, municipality or
6 county conducted by the Federal government and certified by the
7 Secretary of State and for annexations to municipalities, the
8 latest Federal, State or municipal census of the annexed area
9 which has been certified by the Department of Revenue.
10 Allocations to the City of Chicago under this Section are
11 subject to Section 6 of the Hotel Operators' Occupation Tax Act
12 and Section 13 of the Metropolitan Pier and Exposition
13 Authority Act. For the purpose of this Section, the number of
14 individual residents of a county shall be reduced by the number
15 of individuals residing therein in municipalities, but the
16 number of individual residents of the State, county and
17 municipality shall reflect the latest census of any of them.
18 The amounts transferred into the Local Government Distributive
19 Fund pursuant to Section 9 of the Use Tax Act, Section 9 of the
20 Service Use Tax Act, Section 9 of the Service Occupation Tax
21 Act, and Section 3 of the Retailers' Occupation Tax Act, each
22 as now or hereafter amended, pursuant to the amendments of such
23 Sections by Public Act 85-1135, shall be distributed as
24 provided in said Sections.

1 on page 108, line 3, after "Treasurer", by inserting "and
2 Comptroller"; and
 
3 on page 108, by replacing line 21 with "transferred; if in any
4 month 1/8 of the amount requested in that certificate is not
5 available to be transferred from the trust fund into the
6 McCormick Place Expansion Project Fund, the deficiency shall be
7 paid from the amount in the Local Government Distributive Fund
8 that would otherwise be allocated to the City of Chicago under
9 the State Revenue Sharing Act; fourth; the Comptroller shall
10 cause warrants to be drawn from the trust fund to reimburse the
11 City of Chicago for any amounts that were paid from the Local
12 Government Distributive Fund under item "third" that would have
13 been allocated to the City of Chicago, continuing until all
14 reimbursements have been made; fifth, the balance shall be
15 maintained in the"; and
 
16 on page 108, line 22, by replacing "fifth" with "sixth fifth";
17 and
 
18 on page 109, line 5, by replacing "fifth" with "sixth fifth";
19 and
 
20 on page 109, line 12, by replacing "fifth" with "sixth fifth".
