SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the State Operations Continuity Act. Provides that if appropriations and reappropriations for a State fiscal year are not law by July 1 of the fiscal year, then appropriations and reappropriations in the same amount as those for the previous fiscal year become those for the current fiscal year. Contains other provisions. Effective June 1, 2008.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the State
5 Operations Continuity Act.
 
6     Section 5. Fiscal year appropriations based on prior fiscal
7 year appropriations. If appropriations have not been made by
8 law before July 1 of a State fiscal year, then the items that
9 were appropriated for the previous State fiscal year, including
10 supplemental appropriations, are hereby appropriated for the
11 State fiscal year beginning on that July 1, to the same
12 agencies, from the same sources, for the same purposes, and
13 subject to the same conditions, as those amounts ultimately
14 became law, including any item reductions and restorations,
15 item vetoes and overrides, and amendments to those
16 appropriations.
 
17     Section 10. Fiscal year reappropriations based on prior
18 fiscal year reappropriations. If reappropriations have not
19 been made by law before July 1 of a State fiscal year, then the
20 items that were reappropriated for the previous State fiscal
21 year are again reappropriated for State fiscal year beginning
22 on that July 1, to the same agencies, from the same sources,

1 and for the same purposes, but the amounts reappropriated shall
2 be based on the amounts remaining unexpended at the close of
3 business on June 30 preceding that July 1, rather than June 30
4 of the previous calendar year.
 
5     Section 15. Later Public Act making appropriations and
6 reappropriations. If appropriations and reappropriations for a
7 State fiscal year are made pursuant to this Act and a later
8 Public Act makes appropriations and reappropriations for the
9 same State fiscal year, then, unless that later Public Act
10 specifically states otherwise, (i) the items of appropriation
11 and reappropriation under that later Public Act supersede the
12 corresponding items of appropriation and reappropriation made
13 pursuant to this Act, (ii) expenditures and obligations made
14 under the authority of this Act are deemed to have been
15 expended and obligated under the authority of the corresponding
16 item of the later Public Act, (iii) amounts of expenditure made
17 under the authority of this Act are to be subtracted from the
18 corresponding item of appropriation or reappropriation in the
19 later Public Act in determining the amounts available for
20 expenditure under that later Public Act, and (iv) to the extent
21 that expenditures approved by the Comptroller pursuant to
22 appropriations and reappropriations under this Act prior to the
23 effective date of that later Public Act exceed the new
24 appropriation or reappropriation, the new appropriation or
25 reappropriation is increased as a matter of law to the amount

1 of those approved expenditures.
 
2     Section 99. Effective date. This Act takes effect June 1,
3 2008.
