SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/13.6 new

    Amends the State Finance Act. Prohibits appropriations and expenditures for legislative member initiatives. Provides that no legislative member initiative may be funded through a lump sum appropriation. Defines "legislative member initiative". Effective July 1, 2007.

1     AN ACT concerning legislative member initiatives.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 13.6 as follows:
 
6     (30 ILCS 105/13.6 new)
7     Sec. 13.6. Appropriations for legislative member
8 initiatives.
9     (a) A purported appropriation of State funds for a
10 legislative member initiative is not a valid appropriation. No
11 State funds may be expended for a legislative member
12 initiative. No legislative member initiative may be funded
13 through a lump sum appropriation.
14     (b) "Legislative member initiative" means an appropriation
15 for a grant or distribution to a specific unit of local
16 government, specific school district, specific not-for-profit
17 organization, or specific non-governmental entity for
18 infrastructure improvements or operating expenses.
19 Appropriations that are part of a statewide program and are
20 based on generally applicable standards of eligibility are not
21 legislative member initiatives. "Infrastructure improvements"
22 include without limitation capital improvements, capital
23 projects, planning, construction, reconstruction, equipment,

1 utilities, vehicles, and all costs associated with economic
2 development, community programs, educational programs, public
3 health, and public safety.
4     (c) The purpose of this Section is to require full and
5 complete disclosure during the appropriation process of State
6 expenditures that are primarily for a specific local community
7 within a Legislative District or Representative District. This
8 Section shall be liberally construed to effectuate its purpose.
 
9     Section 99. Effective date. This Act takes effect July 1,
10 2007.
